Brown is also well-known. We are Cimpelled to to our own construction of the law. . The Supreme Court of our State has sodnwdcd, therelore, we have nothing to say. So far as the Legislature is concerned, that body aloqe, has the right to say who is, and who •s not, entitled to a seat upon the floor of the H**«se id Representatives. As for Brown nobody expected anything else from him, when the history of our once hand of a truthful and impartial historian the memory of Brown, (who now disgraces the high positron wh*ch he occupies upon the judicial biihcfi of the Supreme Court) will stand prominent at the head of the, list of the infamous, who field place and 'power under the peculiar status of affairs that existed. * Brown the hypocrite declared in his Marietta speech, that negroes were not cli* gibln tn office—the Legislature took his advice and acted upon it. There is no sliarbe* in the breast of such a political prostitute. He has no honor or integrity. Dead and sin, there is nothing too low for him to stoop to, Dear ExGover* nor we voted for you once; but we trust that God has forgiven Us for casting our vote for such a. debauched and degraded wretch. We have never, nor do we intend to utter one word against, those whom we consider honest Republicans; but wc abhor political demagogues, such as Joe Brown, be they Democrat or Republican. Joe res sign—retire to the umbrageous shades of infamy and there think of the numerous dia bolical acts you are guilty of. Do it and we hope crc long you will learn to be a bets ter mau—wo are sure the people will thank you for so doing. Crops in Decatur. — Never was there bet ter prospects for a goad cotton crop, tiisfti at present. Corn is looking as well, or better than wo have evei seen it at this season. Cotton is looking fine—we visited Col. T. A. Swearingen’s plage the other day, and he showed us cotton that would meas ure four feet in height, with plenty of half grown bowls upon it. Several parties have told ns they had cotton waist high, We heard yesterday th.it the catterpillar had made its appearance upon several plantations, but we hope it is untrue. w # m , A Lucky Fellow.— Our friend Bryant of the ThOmasV.ilie Enterprise is one of the luckiest chaps, we know of* He is the recipient of more potatoes, strawberries, and cubages titan any -man we have heard of. We think the last cabage our friend, re cciyed must have been pulled up Gy the roots, and weighed without shaking the dirt off. Negro Eligibility.—The following are the legal points argued before the Supreme Court on the negro eligibility question: Ihe fact that White is a citizen of the United States does not necessarily confer on him the right to bold office. 19 How. aid. 422. 4.Dev, and Butt. 6 24 Wash. C. C. R. 481. Nos does the fact that the Constitution makes him a citizen confer the right, for the same constitution makes u woman and children citizens. Nor does the fact that the constitution of Georgia make him an elector confer that right to hold office. Nor does tlie clause of the Code which declare* tlte right of all citizens, and among them mentions the right to hold oi&ce, for another clause specifies tin: right of persons of color, and does not mention the right to hold office, This latter clause circuit)- ’scribes tlte first by the rule of interprets* tion of the Statutes. Code, 1468 1862. 1 Bishop on Crim. Law 18. D. Warris on Statutes 658, 699, 703, 701, 713. Mr. Akerman*s principal points are that the disabilities of colored men under our old government are not retained,. thiD this government is anew one. not a continua tion of the old: that the Government of the United States and the people of Georgia have declared the old Government destroy ed; that in the preseut Constitution there is no express disqualification of colon and men, that all voters arc eligiable to office unless expressly made itiengiable* that colored men, having participated in framing the Constitution, are to be presumed legally qualified to participate in all privileges under it; that wlien slavery fell, with it the disabilities of free-colored .persons, and the presumptions against them under the old government grew out of slavery ; that the adoption of the old law in the Article X, section 111, does-not revive any local common law, that the constitution Was understood by the large majority of of the Convention which framed it, and by Congress, to leave office Atpen to men of both races; that the right of eligibility exists by stutnte if not by the constitution. The New York Times which Mr. Raymond was editor of, was a Republican sheet, though Conservative in its views.
