D- c. 15 tICNRY CLKWS & Cos ., AND THE CaRTEKSVILLB AND Van Wjsrt RAilboad Company. We have now got somb srtong evidence (says the tlanca Constitution) to show that Henry Clews & Cos., of Hew York, are mixed up knowingly in the improper use of our railroad securities. The !ra con tains a column proclamation from the acting t xecutive reciting a petition of Henry Clews-& Cos., to the effect that they hold and own one hundred and seventy-five bonds of the < artersville and Van Wert \ ailroad 1 ompany, indorsed by the to cover the first fourteen miles of the road for which they paid 90 cents on the dollar, on which bonds the company has failed to pay the interest, wherefore they pray that the executive will seize th e road, and apply the earnings first to pay ing the laborer’s liens and then to the in terest due them. < lews & 0., swear to these statements Upon this petition Mr. < onley seizes the road -and puts it in the hands of 01. D. S- Printup as the 'ate’s receiver. Col* Prin tup is understood to be lews & 1 o’s, at j tomey So that he occupies the two fold ! and conflicting position of attorney for I petitioners and agent of the ctate, if this is true. Now, let us look into tliis moat extraor dinary affair, for it is extraordinary to a ren&rkable degree. Gov- Bullock in his letter to Mr r onley, oi .the bonds, lias these paragraphs: j As to the artersville ard Van Wert or 1 1 heroltee Hoad, that company notified the j Executive Department that they had re i tired, and canceled the * artersvil e and j\ an Wert bonds and would issue under the new charter as ** heroket Hail road."— If the reports be true, the tate is bound only on the C artersville and Van Wert indorsement. It may be said that I should have re quired the cancelled railroad bonds to be returned to the-tate- This would have j been abundant caution, but the bonds were ' BALVBBIDGE. GA.rVHBt 13th 1872 those of the railroad cotApany, and not the Mate, arid I pursued the same course with their notice as with the air-Line Railroad, 'that company reported their bonds can- ’ ceiled, I beiiev? they. ar.e ; tkct'gU M have nover seen them. ?he jne'w^gpet 4 sf ateiSeuts is that holds the i 'artcx-sville and Van Wvvt ' road bonds yet as ° iOflbe and»» him - M{r /c-jcolleetion is < ietvs is or was. t reasurer of pany. If so he would seem to be the oial with whoin those bonds should. have been with the, bonds as t reasnrer and as banker may, * however, be distinct and sepevate' In any the Stub* is bound only’ tor one issue, «ud< .investigation will decide the truth .or fa?- sitj of the company's that the first issue had been retired. It will thus be seen that the Cartersville. and Van Wert, Or Chefrokee RuitypadCom pany, of which Ih-nry Ciews was and is Treasurer, notifies Gov. Bullock that tho bonds mentioned in trie petition of Clews •8c Cos,, were retired and cancelled and new Ounds issued in their stead, fie! rfew bonds indorsed by the State are now out and in use, while Clcjvvs & Cos. hold the cancelled bonds and make their possess ion die basis of their petit lift .for the seizure of I!k! mad and its transfer to their oavu attorney ns receiver on account of tin neglect of the company,.of which Cb-WS is . l'i->;aa«rer, to pay tin* inti iest. Tite situation is this. On the basis ol cahC4*ll(’d bonds, held by Clews banker, and for failure of interests that should be paid by Clews, Treasurer Clews, banker and treasurer, petitions Conley to seize the road who does it unci puts in the hands of Clews alleged attorney. We pretermit any comment upon C'do ne' Printup, uuid it is known whether he still continues to be Clews' attorney He is a gen 'lonian of standing and integrity, and we would not do loin injustice. But Clews & Cos., stand-in no mi viable position. Clews', as Trsastfn rof the com pany, must have known .f the conpaih’s report to Governor B-11 »«k timt the first bonds \V4*re cancelled. And ifTtL-y.’s, as ' banker, held these cancelled bonds as live' and peimitted the new bonds t<r be’ used .by the company, he is party to a direct fraud on the Sta.'e, Where are the new bonds! Clews as ..treasurer, should know this fact. The aspect of fraud is most striking. Mr, Conley has acted most precipitately, it up' pears to us, and negligently. But there in auihor feature of this mat ter, These <ll bunds were issued before five* miles of the road were comph-ti-d, ami therefore mm mu valid. Issued illega ly, the subsequent completion 4). the road does iioi valid it s'.them. Clews, as Treasurer o' the road, was presumed to know its pro gr» ss.tln refore was cognizant ofllie prema ture and iDega* issue of bonds. It is certainly a very st.ange condition of aff.iitv. Did Mr. Clews deceive Govern or Bullock?, Or has Governor Bulk-ck misi'-presented Mr. C1<!W«? It is a bad complication for some one; A private letter fnnn N<-w Y'»rk says thaf •‘Mi, Clews does not enjoy the confidence of the cenmiercialcommunity 4*f,New York, that he abuses Georgia and the Georgia Treasury; that, he asserts he has been a victim, and he did not know Georgia from Bullock, though Bullock was Geosgta.* !
