collector, Mr. L. J. Ragsdale ha
good cause tor feeling proud of his
1897 records as Banks’ State and
county collector. Because, he informs
us that the Comptroler General com
plimented him highly upon his prompt
and good report. His being tha third
settlement made with the State Coin
ptroler.
His list of fifas were unusually
small, and he iutorms us that only
about one half of these are m the
hands of the Deputy sheriff and bail
if;s yet. But he desires to express
his appreciation of the prompt pay
men' of taxes for the year 1897*

CAPE NOT GUILTY*
Gainesville, Ga., January 27.—The
trial of \V. P* Cape, charged with the
murder of ]■ J. Pool at Bethlehem
church, near Bellton, in this county,
was begun in the superior court yes
terday and was concluded this after
noon. Great crowds have attended
the trial and the courtroom has been
packed. The defendaet and the man
who was killed belong to vcr.v promt
ncut families and their standing
made tho case one of unusual interest.
The crime is fresh in the minds of
the people and the sensational stal -

well remembered. Thay were in
attendance upon religious services
when the deed was done, Fool hav
ing escorted Miss Marlin there early
in the day and remained with lier
most of the time. Cape was consid
erably angered at this, it seems, and
at the first opportunity got her and
proposed taking r drive, a proposi
she accepted. While in the act of
hitching his horse to the buggy in
which Miss Martin was seated Pool
came up and stated to Cape that lie
desired to speak to him, walking off
at the satn<‘ time and signaling Cape
to follow, which the latter did-
When at a distance of about thirty
yards from the buggy it is alleged
that Pool assaulted Cape and struck
him a powerful 1 c't over the head, at
the same time grabbing him around
the body and getting his head under
Pool’s breast. It was brought out
in the testimony to day that it was
in this position that Cape took his
knife from his pocket andj with one
powerful effort freed himself from
Pool’s grasp and immediately plung
ed the knife deep into his breast-

for murder by the grand jury last

Miss Marlin was placed on the
stand,b ut no sensational testimony
was brought out ny her. She related
how the tradegy occurred as she saw
it and to’d how she had. seen one of
her suitors * stabbed to death by
another within thirty yards of her
Miss Martin displaveed no emotion'
whatever, but q lietlv answered such
questions as were asked by the attor
uey’s. It is understood that she is
now engaged to Cape, and if he is
freed that they will be married at an
early date.
The defendant made his state
ment, whifth was substantially the
same ns the story of the tradegy as
told above. He said he did no!
want to kill Pool, but that be was
