The, Court of Appeals has handed

in his presence. Resistance, even to
taking life, is declared justifiable by
the court. Under the ruling, Juliue
Ilolmes, a negroe recently convicted
in Bibb county for killing a man

rest him, and who was sentenced for
twenty years, will probably go free.

Bryan No More.
The great majority of tha people
of this country do not want Wil
liam Jennings Bryan for president.
There is no rubbiug this fact out,
It is claimed that money was
usee to secure Taft’s election.
That is true, and it is also true
that money was used in Mr.
Bryans^behalf The republicans
used the most money to na sure,
but the democrats would have
used just as much more if they had
had it.
But if not a dollar had been used
Taft would have been elected.
Mr. Bryan is an able man and a
good man. There has never been
any question a9 to bis character or
as to his sincerity in what he has
advocated. But somehow the peo
ple at large have never felt that
they could Rust him with the presi
dency. They look upon him as a
theorist more than a practical
man.
He will never be president'; but
he will continue to “butt” into pub
lic affairs.
We do not believe the democrat
ic party will go to pieces as a re
sult of the third disastrous defeat
under hit> leadership. But we do
look for itto undergo many radi
cal changes. Just what these
changes will be cannot now be
stated, but one thing £Is certain :
Mr. Bryan will not he the stand
ard bearer any more.
R. R. Bridge Burned.
Tiie Coast Line R.R. bridge acros-

night, of last week and trains were
delayed by transfer of pas-engers

burned was about 100 feet long and

fired by a passing train.

States Rights Upheld.
The supreme court of the United
States has just handed down a de
cision of great importance to Sou
thern whites and, in its effect, of ims
portance to the entire nation.
This decision, briefly, sustained
the Kentucky state government in
ruling that whites and negroes shall
not be educated together in state
institutions. In other words, the
negroes may not attend the state
schools or colleges for whites
The supreme court did not con*
sider the case in its social aspects.
It merely pissed on the question of
law or whether the p >wer of a state
srer its own corporate creatures
comprised the right to amend the
charter of anv school or college so
as to prevent the attendance of ne
groes in that institution. On th is
point the ooart’s opinion, written by
Justice Brewer, ruled assent.
The significant part of the opinion
is its obiter dicta that the white and
blaok races are naturally antagonist
tic and that the enforced separation

The petition of F. H. Wade, C. O.
Misenheimer and W. E. Ingram, ail of
the county of Decatur and State of
Georgia, respectfully shows:
1st. That they desire for then selves,
their associates and successors, to be
incorporated and made a body politic
under the name and style of “CARO
LINA LUMBER COMPANY” for the
period of twenty years.
2nd. The principal office of said Com
pany shall b6 at the town of Attapul-
gus, 6a., in said county aforesaid, but
petitioners desire the right to estalish
branch offices within the state or else
where, whenever the holders of a ma
jority of the stock may so determine.
8rd. The object of said corpo-atior is
S recuniary gain to itself and its share
olders,
4th. The business to be carried on by
said corporation is a general saw mill
and lumber business. It -Iso desires the
right to engage in the na val store busi
ness and any other incident ot the suc
cessful operationjo tne same. It also
desires the right to own and operate a
commissary in connection with said
business.
5th. The capital stock of said corpor
ation shall be Eifty-One Hundred Dol
lars, with the privilege of increasing
the same to the sum of Twenty Thous
and dollars by a majority yote of the
stockholders, said stock to be divided
Into shares of one hundred Dollars each
Ten *>er cent of the amonn t of caoital
to be employed by them has been ac
tually paid in. Petitioners desire the
right to have the subscriptions to said
capital stock paid in money or property
tube taken at a fair valuation.

to make any and all necessary by laws
and regulations, and to do all other
things that may be necessary for the
successful carrying on of said business
including the right to buy, hold and
sell real estate and personal proj erty

tion, and to execute notes and bonds as
evidence of indebtedness incurred,
or which may be incurred in
the conduct of the affairs of the corpora
tion and to secure the same by moort-
gage, security deed, or other form of
.lien, under existing laws.
7th. They desire such other rights,
powers and privileges as are incident
to like corporations or permissi ole un
der the laws of Georgia.
Wherefore, petitioners pray to be in
corporated under the name and style
aforesaid with the powers, privileges
aud immunities herein set forth, and as
are now, or may her eat ter be a corpor
ation of similar character under the
laws of Georgia.
