A terriffle hail storm visited Sumter
county a few days ago and did a great
deal of damage to the peach and cotton
crops. A thousand acres of cotton is
said to have been damaged.

good hotel building, and being on the
corner of one of tho best streets in town
it will no doubt be a popular hotel
when completed.

of Mr. O. B. Perry I will endeavor
to give the renders of the News a
few facts and proof of what he says
I can prove. When the Tax Re
ceiver came around lust year he de
mended the planter to give in his
fertilizers, which I could not un
derstand. I could not find no suer,
law and to satisfy myself I wrote
to one of our representatives who
was a. member of the legislature at
that time, and the following is his
teply:

Dear sir: I am .in receipt of
J our letter of tbe ‘ 27th, inst. and
ig to say in reply that no.law has
been pasted to fnx fertilizers. No
such bill was introduced and you
are evidently laboring under a mis
taken idea. Tbe law is that every
person must return lor taxation all
the property which he owns and
controls on March the 15th. of
each year. I understand thut the
Attorney General has held that
fertilizers are included in the term
"property” und therefore all deal
ers in fertilizers as well as all plan
ters who has fertilizers on the 151b
of March must pay tax on that just
as they pay on other property.
The legislature has nothing to do

with tins nor could it have. The
legislature could not pass a law
exempting uny particular kind of
property from taxation.
The constitution of the state
provides that taxation shall be uni
form and the legislature can not
exempt from taxation any particu
lar class of property. That would
be class legislation. I am informed
thut it hbs not been the custom to
return fertilizers for taxation.- The
Tax Receivers are acting under the
instruction of the Comptroller
General, and the Comptroller Gen
eral is instructed by the Attorney
General. There has been no leg
islation on the subject und will be
none. Trusting that this reply to
