THE LAW OF THE LAND
The graotlng of a nation-wide In
junction against the striking shopmen
has been bitterly assaUed on ail aides
as a measure that is unconstitutional.
There is. of course, a way of proving
whether it la or Is not unconstitutional,
according to the process of our legal
system. This will be carried as It
should be carried and a decision made
al once, In accord with law.
Tha Tlmes-Hnterprlse does not see
how the prevention of free speech and
free assembly can ever stand tbe tests
of our laws. That right Is guaranteed
us, whether we be shopmen or any
body else, and ns long as those as
sembly's are not 1 riotous and provo
cative of actual physical disorder
there is no process that would seeln
ingly stand in Its way.
As far as preventing tbe strikers
from Interferrtng with the running of
railroad trains, K might be effective
under any legal operation, for that
would naturally be a measure of pub
lic protection and safety and as such
entitled to Immediate action by the
courts of tbe land, be they great or
small—a justice of tbe peace can Issue
a peace warrant.
It Is well to attempt to prevent
wrongs against all people, and espec
ially the right and privilege as well as
a duty of tbe government to prevent
tht suffering and hardship tbat will
entail unless trains are run. Very
few .people have any sympathy with
aubotage or with disorders tbat are
meant to intimidate and prevent tbe
carrying on of legitimate business. If
the injunction would merely prevent
the disorders that are recurrent In the
ranks of the strikers, even though
they be without sanction and authori
ty and tbe mere outcropping of a too
radical element, It might stand the
test and be approved in spirit by the
strikers themselves as the law of the
land.
Be that as It may, the law is su
preme and la applied to all ot ua alike..
We cannot afford to say that an order I
of the federal court la a scrap ot .pa-1
per, but we can make every legitimate
effort to prove that It is an error. For
tbat reason the more temperate effort
to have the Injunction denied, In some
respects at least, will prove a means of
enlisting public sympathy as well as
approval. At the same time, the con
stitutional rights of the tellow that
wants the vacant place must be con-
ildered. Under our laws what la If,

Board may feel tbat-it-bas tbe painfull

that can be readily seen on the sur
face for the order that was recently
Issued, and which will be certainly
evaded in one way or another so that
the^lndustry may be preserved.

Senator Smith, of South Carolina,
ihas dropped a lot in our estimation,
when he proposes to stop the growing
ot cotton by federal enactment for a
year, In order to see if the experiment
will not exterminate the boll weevil.
There Is but one reason why this
would not work, and that Is because
the thing might not be successful.
We have little doubt but' that the
entire cotton growing section of the
country would arm itself and prevent
the planting of any cotton, not one
single plant, for a year, It It was as
sured that-it would do away with the
weevil. We could afford to do It from
that standpoint, and profit by It. But
will It work?
If we prevented the growth of cot
ton It would take eternal vigilance
and plenty of It, to keep down cotton
planting In out-of-the-way places, es
pecially as the premium In the price
of cotton during that year would be
enormous, ft could hot be done th
this country without a revolution, and
perhaps not even then. And while It
wns being done the countries that do
raise cotton would make a harvest that
would startle the natives In every
sense ot the word, and perhaps weak
en the position of the cotton growing
section of the United States material
ly.
We are going at the proposition
properly. Senator Smith baa just felt
the Inroads of the weevil In Sou»h di
Carolina and he la merely going
through what the rest of us have al
ready experienced. We are fighting
It extensively and scientifically and
that la properly all that could he de

all tbe roads In some sections while
others got practically none. The
