POWELL DENIED NEW TRIAL by judge love Judge Love Saturday morning de nied the second or an extraordinary motion for a new trial in the case against J. L. Powell, who was in dicted by the grand jury of the Leo- county circuit and convicted f'j r Mur . in conneo- death of James W. vieggetta of Cairo, Ga., which occur red in a local hospital following a shooting affray on Lake Iamonia the night of November 18th. A petition by counsel for Mr. Powell for a reduction of the (500 supcrceadeas bond was also denied by the court. Fred H. Davis and Senator W. C. Hodges are filing an appeal to be returrfablo on March 12, 1923. The Court convened at eleven o'clock with attorneys for Powell, the States Attorney, George W. Walker, States Attorney and W. J. Oven, who assisted him in the prosecution, the jury and a number of spectators in cluding relatives of Powell, present. Senator Hodges opened the argument by reading the extraordinary motion, showing the grounds for which a new trial is asked. He was supported by Fred H. Davis who cited a numbei of cases relating to the subject. Judge Walker oiTered an objection to the motion and cited several cases to support his objection. His objec tion was denied. Sheriff J. R. Jones was then sworn was questioned by attorneys for the defendant regardiH* toe conduct of the jury room and etc. The States \ attorney only asked one question i wtl-ch was "Do you know of your own knowledge of any improper con duct of any member of the jury which heard the case against J, PoweilT The answer being that he did ndt there was no further testi mony taken. The Jaintor of the court house, Walter Norman, was the only other witness called to support the charges. Several affidavits were filed however, supporting the charges made in the motion. Among these affidavits was one signed by the members of the Jury. This one peti tion was denied. Court recessed until January 16th, 1923.—Tallahassee Democrat.
