Mayor and Council • The Committee on Ordinances in obedi ence to the action of the Council at Us last meeting,authorizing them to take into consideration the whole of the existing Or dinance on Licenses, and to report at once the changes proper to be made therein, by reason of the action of the Legislature of the State at its last ses«ion, in regard to the granting of License for the sale of spi rituous or intoxicating liquors, within the corporate limits of the city—beg respect fully to submit the following, as a substi tute for the existing Ordinance on Licenses; and recommend that it be adopted : Ordinance on Licenses. Section 1. Bo it ordained by the Mayor and Council of the City of Thomasville, and it is hereby ordained by virtue of au thority vested in the same by the original charter of said city, and by subsequent leg islative- amendments thereto, That any person or persons, who shall sell or retail spirituous or intoxicating liquors, other titan uialt liquors, within the corporate limits of said City, in quantities less than three gallons, without having first obtained a license for this purpose front the Mayor and Council of said city shall, on convic tion for such offence before the Mayor and any Alderman of said city, be fined in a sum not exceeding fifty dollars and costs of trial, for etch and every such offence; and every and all suqh sale of spirituous-or in toxicating liquors, other than malt liquors, in quantities less than three gallons, within the corporate limits of said city and wit li on t license from the Mayor nui Council as herein prescribed shall constitute a-sepa rate offence. Section 2. Every person wishing to ob tain license to sell or retail spirituous or intoxicating liquors, in quantities less than three gallons, within-the corporate limits of the City of Thomasville, shall make lip plication in willing for such license to the Mayor and Council of said city, at least eight days before the first regular meeting of” lie same that shall be held in tlie month of Maroh : and nil such applications shall contain a definite statement of the place where such sale is to be conducted, and shall be accompanied by a written ceitifi catc, signed by two or more respectable citizens of the neighborhood in which the .applicant resides, declaring such applicant to be a fit person to be entrusted with such license. Section 3. City licenses for the sale of spirituous ov intoxicating liquors, or for any oilier purpose,except when the nature of the bu iness or employment is necessa rily of tv temporary character, shall not be issued for a less period than six months, nor shall ntiy such license continue in lorce longer than the first titty of March next ensuing, after the issuing of such license, and all lees for licenses which nre to con tinue in force for a longer period than three months, shall be paid quarterly in advance. Section 4. All persons seeking to ob tain license to sell or retail spiritn uts or intoxicating liquors shall, before such li cense is i -Lied, enter into a bond wiiti two or more soaui-ities, to be approved hy the Mayor, payable to the Mayor anti Council of the'City of Thomasville, for eight hun dred dollars, and conditioned to keep a de cent arid orderly house ; and any person who after giving such bond and receiving such license, shall foil to keep a elect tit and orderly house shall, on conviction for i Much offence before the Mayor and Council | of said city, forfeit iris or tier License, and lie fined in a sum not exceeding filly dol lars and costs of trial; and nil persons who shall under one license sell or retail spiti 1 - uous or intoxicating liquors in more than one establishment at the same lime, or at nay other than his or her regular place of business, or who after having obtained lioenselo sell or retail spiritnobs or itrori cating liquors, shall transfer or attempt transfer such license to any olive- pors. i, shall be subject to the penalties alrc ;ily prescribed in this sec'ton. Section 6. All persons who nre required by the provision- ot this Ordinance to take out license, and who shall fail to take out such license for a longer period titan fif teen days after the lime prescribed for taking out the same shall have expired, or who shall, after Inking nit license for any purpose, fail to make payment for the same for a longer period than live days after the time at which such payment is required to bo made, shall be fined in a sunt not loss than one dollar, nor greater than tea dol lars, for each day they shall fall to lake out license, or for each day tiicy shall fail to make payment as herein prescribed; and shall also forfeit his or her license til the discretion of the Mayor. Section 6. Any person havi g license from the Mayor and Council, to sell or re tail spirit nous liquors, who shall per mit persons to play and bet at any game or games of chance, Or to stake money or other tiring of value, on any ga ne or games of chance, in any room or building used .by such person, for selling spirit nous or intoxicating liquors, under such license, or who shall sell or furnish directly, or knowingly, through other persons any spirituous or intoxicating liquors to any it inor, or to any person already intoxi cated, such person so offending shall, on conviction thereof bcfi-ro the Mayor and Council of said City, forfeit his or bet- li cense. Section 7 No person or persons shall exhibit publicly, within the corporate lim its of the City of Thomasville, for gain, any kind of theatrical or equestrian perform ance, rope dancing, musical concert, fire works, animal shew, or sleight of hand, without a license from I lie Mayor and Council of said c.ty, for such exhibition, and without having first paid the tax as sessed against Hie same in the annual tax and license ordinance. Section 8. No non resident dentist or dtguprreotypist, or vendor of patent niedi clues, shall ho permitted to exercise iris or her piofession within Hie corporate limits of the City of Thomnsville, without having first obtained tv license from the Mayor and C uncil fir that purpose; and all persons who, after being notified of the require ment!! of litis section, shall fail or refuse iu take out » license ns herein prescribed, shall be fined in a sum not exceeding ten dollars, at the discretion of the Mayor, for each day during which such profession shall be exorcised without license. Section 9 All licenses required by the provisions of this ordinauce to be taken out, shall be granted by the Mayor and Council, and must be issued and signed by the Clerk iu liis official capacity, who shall be entitled to receive One Dollar for each license issued, I" be paid by the person to whom the license is issued Section Iff. From and after the first day of March. 1867, the fees for obtaining li cense to exercise any trade or profession, which trade or profession isrequired by this ordinance to be carried on under license t anil also the rate of taxation upon trades professions and property, within the eorrui rate limits of the city, shall he ns follows : For license to sell or retail spirit u> us or intoxicating liquors other than mail li qu >rs) in quantities less than one quart, the fee shall be SIOOO, to be paid quarterly in advance. For license to sell or retail spirituous or intoxicstiog liquors (other than malt li quors) in quantities of one quait or by grqnter measure, the fee shall be $25, to be paid on the issuing of license. For Licenses to venders of lottery - tickets and gift associations, the fee shall be, per month, $50.00 For Agencies of Express Coinpa pnnies, each, per annum, 75.00 For Vendue Masters, each, per annum, .... 50.00 For Billiard Tables and Bowling Alleys, each, per annum, 50.00 For I’edlers and Itinerant venders of goods, wares and merchan dise, for the first week, 150.00 For each week thereafter, 50.00 The fee for license to peddle by the month shall be, 50.00 The fee for hucksters and keepers of cake and fruit stands, each, per annum, , . . 10.00 The fee on each Insurance Com pany having an agency within the city, . . . 10.00 The fee on Bank Agencies, 100.00 The fee on non-resident Daguer rean aud Photograph artiste, per month, .... 10.00 The tax on non resident lawyers and physicians, having offices in the city, shall be, per annum, 10.00 License fee for menageries and circus companies, for each exhi bition 60.09 License fee for all other shows or exhibitions for gain, for each exhit ition-, . , . 15.00 The tax on livery stables shall be, each, per annum, . . 60.00 The tax on all slock drovers of horses arid mulfs, &c., for each day during which they shall of fer for sale nny horses or mules, 2.00 The license for regular butchers and ethers who use stalls in the Market House, the fee shall be, per annum, .. . . 60.-00 The license for four horse omni buses or hacks, per annum, 30.00 The license for two horse omni buses or hacks, per annum, 20.00 The license tor two horse drays or wagons, per annum, . , 20.00 The license for one horse drays or wagons, per annum, . . 10.00 The tax on all hogs, pigs, sheep and goats, slaughtered and of fered for sale within the corpo rate linrils, per head, . 20c. The tax on all beeves, per head, 60c. * Marks nnd brands of till .slaughtered ani mals to be exhibited to the Marshal. The rate of taxation on real estate and stock in trade shall lte determined by the exigencies of the city, and shall be suffi cient to defray the indebtedness of the cor poration; tlie assessment to be made here after according to the*return of the receiv ers of the tax t ctu ns. The tax on goods sold at auction shall be one per cent ; auctioneers to make monthly n turns to the Clerk of Council, and to collect and pay over to him the amount ot lax tine, under a penally of not ■ more than $26.00 for failure or refusal so j to do. • The tax on all goods and merchandize, ; sold on cominis ion within the corporate 1 limits shall be one.per cent, on the gross j sales, vendors to make monthly returns to the Clerk of Council, under a like peually, as in the case of vendue masters. A lax ofter. cen:s per bale is hereby as sessed on caclt bale of Colton stored or remaining within the corporate limits of t bo city, af cr the first day of March, 1807, which tax shall be collected at and paid to the Clerk of Council, by the owner or keeper of the warehouse, room, or build iug iu which such cotton may be placed or stored, under a penalty of not less than five dollars for each bale, on which the tax herein assessed is not paid ; and it shall be the duty of the Marshal to pro cure from each person having Cotton stored on their premises, and furnish to t lie Clerk of Council, a monthly statement of the number of bales so stored or kept by them, together with the names of the owner or owners of such Cotton. Section 11. All pt-olticc, fresh meals, but lev, nnd poultry, shall bo oprried to the Market House, and there offered for sale. In i ween the hours ol 5 A. AI„ and 10 A. M. The charges for hauling within the corpo ratf limits triiall be as follows : For all two horse drays or vvagons 75 cfs, per loa I. For all one horse drays or wagons, 371 cts. per load. Section 12. In addition to the license fees prescribed in the 10th Section of litis Ordinance, the following tax is hereby as sessed against and required to le paid by all vendors of spirituous or intoxicating liquors, in quantities of one quart or by greater measure, to wit : Twenty five cents per gallon on every gallon sold ; t he amount ot tax to lte ast et tained from vendor's re turn, which shall be given in under oath, to the Clerk of Council, at, the expirati n of each quarter, and the lux shall be paid at the same time.
