Cos it ordained by the Mayor and Council-of tLe City of Thouiasvillc, and it is hereby ordained by virlue of au thority vested in the same by 1 lie original charter of said city, and by subsequent leg islative amendments thereto, That any person or persons, who shall sell or retail spirituous or intoxicating liquors, other than malt liquors, within the corporate limits of said City, in quantities less than three gallons, without having first obtained a license for this purpose front the Mayor and Council of said city shall, on couvio . ifqn for guefi offence before the Mayor anil any Alderman of said city, he fined in a suru not exceeding fifty dollars and costs of trial, for eicli and every such ofi'uncc ; and every and all such gale of spirituous or in toxicating liquors, other than malt liquors, in quantities less than three gallons, within the corporate limits of said city and with out license front the Mayor and Council as herein prescribed shall constitute a sepa rate offence. Section 2. livery person wishing to ob tain license (o sell or retail spirituous or intoxicating liquors, in quantities less than three gallons, within the corporate limits of the City of Thomasville, shall make ap plication in writing for such license to the Mayor and Council of said city, at least eight days before the first regular meeting of the same that shall be belli in the month of March -. and all such applications shall contain a definite statement of the place where such sale is to be conducted, and shall bo accompanied by a written certifi cate, signed by two or more respectable citizens of the neighborhood in which the applicant resides, declaring such applicant to he a tit person to he cut rusted with such license. Section 3, City licenses for the sale of spirituous dr intoxicating liquors, or for any other purpose,except when the nature of the bu iucss or employ meat ig necessa rily of a temporary character, shall not he issued for a less period than six month?, nor shall any such license continue iu force longer than the first day of March next ensuing, after the issuing of such license, and all fees for licenses whieh are to con tinue in force for a longer period than three months, shall be paid quarterly in advance. , .Section 4. All persons seeking to ob tain llcefise to soli or retail spirituous or intoxicating liquors shall, before such li cense is issued, enter into a bond with two or more se-urities, to be. approved by the Mayor, payable to the Mayor and Council of the City of Thomasville, for eight hun dred dollars, and conditioned to keep a de cent and orderly house ; and any person who alter giving such bond and receiving such license, shall fail to keep a decent and orderly house shall, on conviction for such offence before the Mayor and Council of said oily, forfeit his or hpr License, and be fined in a sum not exceeding fifty dol lars and costs of trial; and all persons who shall under one license sell or retail spirit uous or intoxicating liquors in more tiian one establishment at the sumo time, or at any other than his or her regular place of business, or who after having obtained license to sell or retail spirituous or intoxi cating liquors, shall transfer or attempt to transfer such license lo any other person, shall bo subject to the penalties already prescribed in this section.
