Under a decision of the Supreme
Court rendered yesterday, the At
lanta, Birmingham and Atlantic Rail
road company will be permitted to
condemn certain property In the city
of LaGraiige to be used as part of the
right of way, which is now the prop
erty of the /Atlanta and West oint
Railroad Company.
This petltidn came on as the result
of the new. railroad’s efforts to get
Into LaGrange. • The West Poiht had
secured practically the only available
property which the Atlanta, Birming
ham and Atlantic needed to get Into
LaGrange. The West Point was not
using the property, and is not now
using thls'proporty, but claimed that
it would need it in the future for rail
road purposes and It at as railroad
property it was not subject to con
demnation.' ■ v
The Supreme Court In sustaining
Judge Pendleton in refusing to grant
the injunction asked for by the West
Point, says that tlie railroad may con
demn and acquire the property of an
other railroad, if such property is
not in actual use for railroad pur
poses. Property which is acquired
by a railroad company tor future use
the Supreme Court Bays, is on ex
actly the same basis as private prop
erty, and may be condemned in like
manner. V j
This decision will give the Atlanta
Birmingham and Atlantic the en
trance to LaGrange which it desires.

man’s Home and Foreign Missionary
Societies was held at Pelham Oct. 26.
