Hie Duren Matter—The
< C. L. Well-Other
'§ Live Topics. '
Present: Hansell, Lewis, Parker,
Neel, Era ns, ^toilette and the mayor.
In. the seven-handed game of talk
at the city council meeting'&n Tues
day night, thn last word was spoken
at ten o’clock. /During the session o? •<
two hours and a half the.discussion
covered a variety- of topics of Inter
sil from tin cans to blind tigers.
A Brother's Plea.
An hour was taken up with the
discussion of the case of Tom
Duren, who Is under sentence of
work, fall and a tine, for keeping
■quor for sale. ^ A petition to the
, council to remit all but.-Je fli^e was
tabled at- a meeting several weeks
- ago. Another/petition was present-
by kr. Renau Duren off Merrillville,
a brother of the man under sentence.
tt, Is not* an orator, but he made, a
simple,, earnest plea that was ac
corded respectful consideration. He
said that he had made up his mind
aot to take any part In the case,
but matters bad reached such a stage
that be felt he must act. “I am
. ready to pay the fine tonight," he
said, “If you will keep him off the
streets. My brother 1s going ouf of
i the business. You hive persecuted
him enough and now you are perse
cuting his family. His wife Is sick
aver it. - Over at the school the oth
er children point at his children and
say theft father,la a liquor seller^
It has gone far enough and I would
be glad If you all'would relieve him.
An Uneasy Silence.
The council heard this plea In un
easy silence. The aldermen looked
at Jim Evans and he broke the Ice.
He said that so far as the coucll
waa concerned It was powerless to
’act and he did not see why they
should interfere with a recommenda
tion In. a matter of law. .This same
matter had been laid on the table
,ance.
A Petition Suggested.
This did not satisfy Mr. Duren.
gorged that the council fake some
and either refuse to* act or
•a something. Alderman Mallette
said: "I stand Jhst where I did he
lm. I ain a prohibitionist and I
, want to observe, the law, but I think
this is a case for mercy. Not on
account of this man Duren, but on
account of his wife and children. He
has quit business and. qu|j (or good.
He has been sufficiently” punished."
Alderman Hansell .yoke: “In view
sf all the facts lp this case I would
suggest that the council petition the
governor and the prison Commission
id commute this sentenc#*.n> a fine.”
I am as sorry as any brother ho has.
But vre were elected, and we took
tho oath of office to enforce the law.
We cannot deviate from this on ac
count of any one man. Sympathy
fnust hot swerve or sway pa. We
fought this matter ny precept. We
spent money, not dollars but hun
dreds to break up the traffic, Thlnfis
were getting In a ^terrible chape.
Young men were-belng ruined. Pub
lic meetings of citizens were held.
The Law add Morality^league met
In secret. Not until a work sentence
was put on these men did the sale
stop,. It has stopped now. 8hs!l we
undo all this? If we petition 'the
governor to turn Duren' loose of
coursn_ho will do It. We will hsve
to do the same for the next man.
We will have established a' prece
dent. Then the effect of -the law will
be nullified. We might as well have
no law. The people who elected us
knew we were dry men. They look
to us to enforce the law. I am op
posed to the council compromising
with the sale of liquor.”
' Tho Only Wet Man.
Alderman Lewie said: "I feel
like .a child born out of time. , I nm
the^ply man on this council who,
voted a wet ticket. ‘ But I am no
blind tiger man:' I believe In enforc
ing the law. Still the people are
the law. When thesb people j:ome
to \u with a petition, and ask us
to'show clemency to Duren. I nm
willing to do It. That Is my posi
tion.”
' Alderman Neel - , took the ground
that such a petition to the Governor
Would ensure Duren’s release, would
be a cessation of the fight against
blind tigers, and he opposed It.
The Postponement.
Alderman Evans called attention
to the tact that the validity of the
ordinance had not been settled, that
Duren was still fighting the matter,
and habeas corpus proceedings would
throw It into the supreme court, and
suggested that the council postpone
action until the case was finally
settled j by the supreme court. Al
derman Parker and Neel voted with
hint on tills motion.. Aldermen Han
sell, Mallette and Lewis voted against
it. Mayor Pittman broke the tie by
voting for the pbstponement.
