The people of ThomasvUlc have
ceased to be surprised at anythin;; j
that may develop In the Futch fam
ily’s checkered history during the
past few months. They were not
amazed yesterday to learn of what
the family believes to be another at
tempt to put them out of the way.
this time it was neither by fire or
poison but by the msterlous approach
of a night marauder, whose purpose
was unknown, and who was frighten
ed away before he could carry Into
effect, whatever It was.
This is about the ninth sensation
that these people have furnished
the country In which they live. The
latest, development In the care was
Sunday night. Mr. M. B. Jones was
told of the affair, his home being be
tween ThomasvlUe and the Futch
place. He came to town reaching
here at one o’clock yesterday morn
ing. Once more he summoned from
his bed that faithful friend of the
family. Rev. T. A. White- who in
company with Hon. Fondren Mit
chell and Mr. Jesse D. Stringer went
to the scene of the oft repeated dif
ficulty. They returned homo late
last night, and this is the story they
bring with them:
Since the attempt to blow up Mrs.
Futch and her son Allie by means of
a rude bomb last Monday night they
have secured the services of a white
man to guard their home at night.
He was armed with a'double barrel
led shot-gun and instructed to stop
all who approached after darkness
fell. At nine o’clock Sunday night
ho saw a white man stealthily ap
proaching. His instructions were to
hail all who approached from the
front. Ho hailed the intruder Just
before he reached the gate.
The mysterious visitor seemed al
armed at the situation and dodged
behind two big oaks that stand no.ir
the gate. At this suspicion?, action
the watchman raised his gun and
pulled the trigger. The gun snap-
lied and missed fire. The nocturnal
visitor then took to his heels n t full
speed, and by tho time the watch
man had tho other barrel ready to
fire ho was out of range. The guard
ran after him and chased him ncroffs
the field but was soon distanced and
the Intruder made his escape. In
tho darkness* it was impossible to
see the man well, and the guard Is
not even sure he was a white man.

New Turn In Fight of Shippers
Against the Railroads.
Savannah, Jan. 11.—Instead of a
mandamus, the lumbermen obtain
ed last night an injunction against
the Central of Georgia, restraining It
from refusing to accept cars from
other roads. This course was de
cided on at a meeting of the Lum
ber Committee of the Board of Trade
held at noon.
It is the opinion of the lumber
men that the evils complained of *an
be much more speedily righted by an
injunction than by application for a
mandamus, chiefly for the reason
that an injunction could be obtain
ed so much more speedily, and will
force the Central to receive the cars
tendered by other roads first, and
talk about the matter afterwards.
While conditions have improved
considerably, the lumbermen are de
sirous of providing a permanent re
lief instead of one which may be on
ly temporary at best. If the injunc
tion can be made permanent—and
the lumbermen are confident that the
law is on their side—the railroad
which refused to accept a car from a
connecting line, or in other words,
the road which dares to deelare an
embargo, will run squarely afoul of
an injunction, present or potential.
And this is what the long-suffering
lumbermen yearn for.
If rules 13 and 14 promulgated by
the railroad commission are within
the powers of the commission—the
rules making It obligatory on tho in
itial line to deliver and the receiv
ing line to accept—the lumbermen
want that fact established by tho
courts.
If the rules are ultra vires so far
as the commission Is concerned the
sooner the lumbermen find this out
the better, so they believe. If not,
enforceable, the lumbermen will go
before the legislature and ask that
a law be passed making tho accept
ing of cars obligatory by tho road to
which they are tendered.

ten to a point where It Is necessary
to find If we have any rights. If
o have no rights then wo want tho
legislature to delegate that power to
the commission.
