Aaberllle, N. C., July 18.—Jamea
H. Wood,, district passenger agent,
and Ticket Agent O. C. Wilson, of
the Southern railway, were found
guilty in the police court today of
selling ticket* In violation of th« new
state law, and each was sentenced to
thirty days In the chaingang.
Raleigh, N. C., July 18.—After a
day of argument by counsel yester
day for T. E. Green, ticket agent,
and the Southern Railway, pleading
for a continuance of the criminal
case against them In tne superior
court here, presided over by Judge
B. F. Long, on the charge of violat
ing the state railroad rate law, the
court overruled all motions and or
dered the trial to proceed today.
General Counsel A. P. Thom, of
the Southern, la here from Washing
ton. Pleas for delay, so aa to pre
pare the case, for want of jurisdic
tion, for unconstitutionally of too
law and for quaahng the Indictments
were made. Judge Long overruled
all of the motlona and directed that c
plea of "not guilty" be entered. Af
ter argument this morning the court
took a recess until 12 o'clock.
Twenty minutes before this tlmo
Judge Long convened court again
and ordered that Green, who had
been In jail all night, he taken from
the custody of the sheriff and held In
the custody of the court. It will now
be necessary that any writ Issued for
Green shall' be directed against
Judge Long, presiding In the super
ior court, and In effect the writ
should be to dispossess a state of
auti-orlty In a criminal proceeding.
That Judge Long will decline to
surrender Green In obedience to a
writ of habeas corpus from tie fed
eral Judge Is generally believed. A
lele,-ram from Asheville says that
Judge Pritchard Is on the way to Ra
leigh, having moiled the writ on an
earlier train.

state rate law was yesterday after
noon found against General Passen

Railway Company.
