St. Louis, Mo., December 16.—'The
case of Henry Clay Fierce, who was
arrested last spring following a Texas
indictment against him charging pet-
jurv, is on the docket for hearing
tomorrow in the United States Circuit
court of Appeals here. Following ills
arrest last May Mr. Pierce applied fo.-
a writ of habeas corpus before Judge
Adams in the United States circuit
court. The writ was dented, and Mr.
Fierce took appeal to the circuit court
of appeals and the United States Su
preme court.
The indictment, found against Mr.
Pierce by the Texas grand Jury
-•barges false swearing in connection
with the affairs of the Waters-Pierce
Oil Company, of which Mr. Pietce is
chairman of the board. The Indict-
ment was returned by the grand jury
f Travis county, Texas, it charges
that Pierce, on May 31, 1!t0U, made an
affidavit that the Waters-Pierce Oil
Company had not entered into any
agreement or understanding with any
corporation, partnership, firm, or indi- j
vidual to regulate the price of any j

piest prisoners are certainly those
who do go mad. Passanante. who «t-

Italy, has been in a mad house for
rears. I am the only man who has
resisted solitary confinement, the only-
man who has not died or gone mad in
it after a few years. My method was
a constant mental struggle, a sort of
intellectual gymnastics, by means of
which I kept my thoughts off my
abominable solitude. 1 lost all no
tion of time, of course, and I remem
ber asking my jailer one day what
the year was. He would not tell me,
but next day as he was putting down
my Jug of water he muttered TS86.'
I had been in prison five years and be
lieved l had 20 more to serve.”
