Johnny has not yet definitely made up his mind about going to the uni versity, but is thinking it over, and according to several of his friends, Coach Cunningham's squad will soon be augmented by the presence of the crack Savannah gridiron gladiator. Last season Cooley was a member of the local all star aggregation which swept the Jacksonville and Charles ton elevens before it in the inter-city games played here Christmas and New Years'. He was a star In both these games and provided he enters the university this fall, his many friends here will follow with interest his career as a member of Coach Cun ningham's aggregation. DOPE BY DAN. Beginning this week practice by the Georgia football squads will set tle down to a steady grind. Almost impossible it is yet to determine the good qualties of the new men. The lir,e-up for the first two weeks will be a problem difficult to solve. The old men get first choice and it is up to the new men to prove more capable and when they show to better advan tage they will win a place. There are not enough suits to go around and with candidates clamoring for uni forms there is a chance of some good men being lost to the team. It will take good steady nerve to stand the hard practice week and when the real work starts the weak- hearted will fall out. “Cold Footed." It has been considered a disgrace the University for a fellow to show lark of nerve and when a boy has the size and ability to help the team and falls dow-n through lack of nerve, the student body gives him the title "Cold Footed," and to them he re mains under this stigma until he can show the mistake. While Sister is in Atlant aHospital, Miss Dunham Dies in Hospital Here Yesterday morning shortly after midnight occurred the death of Miss Gussie Dunham at the hospital. The following letter will be of In terest: “The Fourth Annual Convention of the Mississippi to Atlantic Inland Wa terway Association will be held at Montgomery, Ala, November 20-21-22, 1911. This will he a most important convention and will be addressed by men known throughout the country, familiar with the problems Involved, and deal with subjects of very great concern to the Atlantic and Gnlf States, and adjoining states, looking to Increased transportation facilities, and the development of Indus tries la (Special to the Banner.) Atlanta, Ga, Sept. 18.—Thomas J. Shackelford was this afternoon sworn in by Gov. Hoke Smith as judge of the city court of Athens. He received his commission. This he considers offic ially constituting him judge of the city court of Athens, a position still held by Jurge H. S. WesL whose term has expired, on the grounds that Mr. Shackelford’s appointment was not confirmed by the senate and that therefore no vacancy, occurred. Before coming to Atlanta today Mr. Shackelford .was informally notified bj Judge C. H. Brand that Judge West had applied to him for an injunction to prevent Mr. Shackelford from tak ing the office under the commission of the governor. Judge Brand has set the matter for a hearing on next Saturday in Athens. Mr. Shackelford stated today that he was undecided as yet whether he will rest his case upon the injunction proceedings which Judge West has In stituted or would institute himself quo warranto proceedings for the pur pose of ousting Judge West from the office. The contentions of Judge West and Judge Shackelford are well known, hinging altogether on the senate’s failure to confirm the governor’s ap pointment of Mr. Shackelford. Mr. Shackelford has spent the day in At lanta studying over the case in the state library and conferring with the governor. He says he finds no record whatever In the senate Journal of the confirmation of the appointment of Judge West, when that appointment was made bf Gov. Brown on the death of Judge Howell Cobb, then the incumbenL He says that he was In formed that there is no record of it in the senate papers filed under seal with the secretary of state. This as sertion of Mr. Shackelford may figure In an Important manner In the litiga tion over the office. Mr. Shackelford will return to Athens at once and be gin preparations to meet the Injunc tion case before Judge Brand. Atlanta, Ga, Sept. 18.—Special to the Banner.—The afternoon Georgian contained the following story from an interview with Col. T. J. Shackelford of Athens, which will be of interest to the many who are watching for de velopments in the city court judge- ship contest in Clarke county: From the Georgian. One side of the Athens city court judgship controversy was transferred to Atlanta Monday, when Judge T. J. Shackelford spent several hours in the state library at the capitol “read ing up” on the law relative to the ap pointment of city court judges and the creation of the Athens city court. Judge Shackelford was recently ap pointed judge of this court as an in terim appointment by Governor Hoke Smith, after the state senate had de clined to consider this with several other appointments made by the gov ernor while the legislature was in ses sion. Judge H. S. WesL the incum bent, whom Judge Shackelford was named to succeed, has declined to re tire and is resisting in the ocurts the claim of Judge Shackeford to the of fice. Judge Shackelford said he had been Informed by Judge C. H. Brand that the latter had Issued a temporary In junction petitioned for by Judge West to prevent Judge Shackelford sitting on the bench in the Athens court. However, he had not been served with the papers in the injunction case and all directions. “We ask that you appoint ten dele gates to the convention, and send names and addresses to the under signed. “An early reply will he appreciated. “Yours truly, “Mississippi to Atlantic Inland Wa terway i Association, Lelaad J. Henderson, Secretary." Those appointed by the mayor to represent Athens are among the lead ing business men of this city. They are: Messrs. W. S. Holman, C. B. Griffith, W. T. Bryan, M. G. Michael, J. E. Talmadge, Jr, E. H. Dorsey, W. H. Morton. C. H. Phinlzy, J. N. Webb, and G. H. Hutmst did not know when it would come up for hearing. He expects that proceed ing in a few days. In the meantime he is making no effort to assume the judicial functions other than prepar ing himself for the litigation that has been launched. In the library Judge Shackelford hunted up the legislative act passed back in the seventies, creating the ‘‘city court of Clarke county.” Ho also looked through the senate jour nal of 1909, the first session following the appointment fo Judge West to the bench. It is said that journal shows now record of his appointment ever having been confirmed. Judge eWst was appointed some thing more than two years ago to fill cut the unexpired term of the late Judge Howell Cobb, whose term would have expired on September 12, 1911, the adte from which Judge Shackelford’s appointment dates. Judge West contends that until the appointment of his successor is con firmed by the senate no vacancy ex ists in this courL Judge Shackel ford’s contention is that he has been regularly appointed to this office and sholud have been permitted to quali fy and assume it on September 12. It is a matter for the courts to deter mine as to which contention is cor- recL There is no contest as to solicitor of this court, S. C. Upson having been reappointed.
