f— UNCLAIMED BANK DEPOSITS
“■ft.-case carried to the Supreme Court of the United
-States from California for the purpose of determin
ing the proper disposition to be made t o[ unclaimed
(deposits in banks has attracted unusual attention
, throughout the country. The courts of California up-
;held the state law which permits the state to be
come possessed of bank deposits which remain un
claimed for more than 20 years, and the decision of
the state court was upheld by the United States
Supreme Court.
• The Wilmington (N. C.) Star in commenting on
the decision has the following to say:
■ r '‘The bank contended that the statute® violated
rights guaranteed to a state bank by the federal con
stitution.and that they were obnoxious to both the
contract clause and the due process clause. The
California Supreme Court decided for the state and
the federal Supreme Court holds with that decision.
The California statutes under which the contention
arose provides that if a bank account has not been
added tb or been drawn upon by a depositor for more
tijan 20 years and no one claiming the money has
within that period filed with the bank any notice
showing his present .residence, and the president or
managing officer of the bank does not know that the
depositor is alive, then the bank shall, upon entry of
a (judgment establish these facts, deposit with the
‘state treasurer the amount of the unclaimed deposit
and accumulations. The state cannot begin suit
. ’against a bank till after 20 yean.
“''There have been many instances of unclaimed
deposits in banks, and possibly many of them would
be claimed if the fact were sufficiently advertised
before the state begins action. Even after the de
posit has been converted into the state treasury
aqdbona fide claim is proven the state should hold
; itself responsible to the claimant. Otherwise the
bank would be responsible, it would seem, although
l it might be relieved by the action, taken by a state.’’ i
LET THE SUPREME COURT STAND
. - • For several years there has been a hue and cry
from disgruntled politicians, labor leaders and cor
porations desiring special favors for radical chang-
, es in the present system as inaugurated by the
.. judges of that court. Some of the congressmen and
senators have suggested and urged a proposed bill
requiring that seven out of the nine judges concur
, iu pronouncing any Act of Congress unconstitutional.
Some propose to amend the constitution by the pass
age of a measure so that if the Supreme Court Fed-
~ ,ctal Judges declare an Act of Congress unconstitu-
tfianal, Congress may, by re-enacting the law, nuili-
fy the court action. These and many more pro-
- -pored measures have been discussed in order to
reach control of the highest court in the nation in
order that it may be used to render such decisions
as will be in keeping with those who do not stand
fpr the enforcement of the laws, but represent special
interests and are seeking special favors.
' As the court now stands it is a five to four de
lusion. Under the proposed plan it would require
a vote of 7 to 2 before an Act of Congress could be
(teeiared unconstitutional. It is better that the
present system remain In force. For over a century
this-court has been established and now for it to be
ip-ought into politics and bickered with by the special
; interests tys usefulness will be destroyed and the
rights of the people taken from them,

stand soiidiy against any interference whatever with

which is being applied in the deliberations of the
highest court in our land.
