are voidable, according to an op*
inion rendered Thursday by At*

quest of Henry McAIpin, Chat
ham county ordinary, at Savan*.

eral stating that, since passage
of the Georgia law requiring five
days’ publication of marriage no*
s prior to issuance of licens-
many Savannah couples mat
in South Carolina and return
to their homes in Savannah to
live*.
In ruling that such marriages
arf voidable, the attorney general
cites Section 2043 of the Georgia
code, which reads:
“Parties residing in this state
cannot evade any of the provis*
ions of ite laws as to (marriage by
going into another state for the
foJemniration of the marriage
ceremony.”
Mr. Napier* also cites the su
preme court” of the state, which
has laid dswn the principle that
Georgia courts will not regard
whnt is known as the doctrine of
comity of states; in this case in
volving recognition of contracts
executed in South Carolina when
enforcement or recognition
such contracts i» contrary to the
policy of the laws of Georgia or
prejudicial to *he interests of this
state.
In siating his opinion that such
marriages orb voidable, the attor
ney general says that “the pro
tection of the parties such as
they would have under the mar
riage contract assumed under the
provisions of the laws of Geor
gia, will be found wanting, in the
event proceedings arise which will
bring to the knowledge of the
courts the fact that they left this
state ami went into another state
in order to evade he laws of the
atr.te of Georgia.”
The Georgia law requiring post
ing of public notice for five days
before a marriage license is is-
ued, passed by the legislature two
years ago, has resulted in many
Georgia couples going to South
Carolina, Tennessee, Alabama or
Florida to be married in order to
avoid this requirement. It has
bce.t the subject of much discus
sion among public officials, minis
ters and members of the general
assembly. Efforts to repeal or
change the law met failure in the
last legislature. ^ i
