Durkin Case Expected
To Go To Jury Friday
Night As State Closes
CHICAGO.—(UP)—The case of Martin Durkin,
who is described by the state as the “cold blooded
murderer” of Federal Agent Shanahan and by the
defense as a “good citizen who shot in seif defense”
when he thought he was being robbed, Friday was
expected to be in the hands of the jury before night.
Defense Attorney Eugene 'Me —
Carry intended to finish his im-
pasioned plea for Durkin by
noon. The state will then close.
Attacking the “lawlessness of
the law” and lauding Shanahan's
zeal, .McGarry told the jurors just
before court adjourned late Thurs
day that Detective Sargeant
Naughton was the “real murderer
of Shanahan."
Shanahan was shot and killed
when he attempted to arrest Dur
kin in a Chicago east side garaj
Naughton, according to his own
testimony had left the garage be
fore the shooting and had ordered
Shanahan in. The defence con
tends Durkin thought the federal
agent was a robber and that Shan
ahan, being ar federal agent, had
no authority to make an arrest.

—(UP)-^- Bill Melhorn of
Chicago Friday was un
able to keep up the pace
he set Thursday' in the
National Open. Golf
Championship at Scioto
Country Club and his
lead stood in danger after
he had added a 75 to his
record of 69 of Saturday.
His total of 143 for 36
holes furnished a shining
mark for Bobby Jones
and possibly others to
shoot at in later, rounds)
of the day.
It was a good golf day although
tho hoat was excessive and a Htiff
L'reeze bothered the players on
some holes.
Melhorn started almost a« fast
as ho did Thursday and got
through the first nine holes in
perfect figures of 36. He turned
for home with two pars but at the
646 yard 12th hole, he got in a
hazard and recovering only after
difficulty, took a 6. He was also
one above par on tho 13th, where
the wind bothered him and he
could not get back on his feet,
ending with 3 pars for a 39.
Temporarily the early lead had
been taken by Joe Turnesa of New
York, who added a 74 to his sub-
par 71 for a total of 146, which
turned out to be two strokes be
hind Melhorn. Al Espinosa, Chi-
cago, who starting with a 71, had
a good chance to take the lead, fell
off to a ,79 Vriday and with 150,
was seven strokes behind Melhorn.
Willie 'MarFarlane, defending
champion, started fairly well but
was one iibovo 4’s arter six holes.
Chick Evans was> ono under 4’s at
tho same point, while Walter
Hagen was 2 above par in three
holes.
Melhorn's CS, garnered Thurs
day over the first 18 holes, wan
two better than the card turned
ln by Bobby Jones, the American
Amateur and British Open title
holder and John Junor, Portland.
Oregon, who at tho last minute
loomed as formidable contender.
Al Espinosa, Chicago, and Joe
Tumosa, New York, collected 71
strokes, ono stroko better than
Willie MacFarlane. the defending
champion. Pat Doyle, Leo Diegel
and J. G. Collins, the latter a Ko

Friday’s play was over 18 hole.**
