Atlanta, Ga,, Oct. 5.—[Special.]—
In the Senate this morning Senator
Terrell introduced a bill providing for
a means of relieving the Stitts . r the
increasing pension demands. The bill
provides for an amendment of tn t - Gon-
stifution so as to provide for the issue
of $500,000. in bonis annually. The
money to go to the payment of pen
sions, the excess if any, to go the school
fund. The argument in favor -*f the
bill is that by this means the tax rate
can be reduced and the burdens of pay
ing the pensions need not be bor.*-- et -
lirely by the tax payers of tods but
a portion of it can be shifted to the next
generation. Treasurer Hardeman, in
' conversation this * morning
gave i his hearty en
dorsement of the measure and a good
many members of the legislature con
sider it a happy solution of this much
vexed question.

bis decision. , .
,There had been a motion to remand
ifctothe superior court of Clarke county,
because it was claimed that the Uuited
States had no juri-diction to hear and
determine the issues involved therein.
In his descision Juatic-t 'Lamar .'states
that the complainants were numerous
and had been stockholders in the North
eastern railroad, a Georgia corporation,
eie, with, four exceptions,
Georgia. The motion tore-
hnand was sustained.
Hence It comes b ick to its original
place on tbe docket of Clarke Superior
Court and will stand for trial before
that^tribunal. f
The progress of this case wills be
watched with extreme interest, as it has
a bearing upon many things in which
Athens is interested.
Iii the case as argued before Justice
Lamar, the plaintiffs were represented
by Messrs. J H. Lumpkin, Lumpkin &
Burnett and T. W. Rucker, and the de
fendants by Messrs. Calhoun, King &
Spalding and Jackson & Jackson.
It was a tough legal battle but the
Athens attorneys won the fight.
