and AAA decisisions is the old
question of the rights of the
states. The constitutional guaran
tee of state rights is as follows:
“The powers not delegated to
the United States by the consti
tution, nor prohibited by it to the
states, are reserved to the states
respectively, or to the people.” |
Thig doctrine is not in the orig
inal constitution, It was put into
effect, itself, by amendment. It
is the tenth amendment, drafte |
by the first session of congress.
Under the constitution, it canbe
replaced by another amendment.
Down through the years, in
questions concerning the constitu
tion and the ‘Supreme = Court,
there is inconsistency. The court
reversed itself in the legal tender
cases. Its decision in the Dred
shot case was completely wiped
out by the thirteenth, fourteenth
and fifteenth amendments. The
states enacted the eighteenth (pro
hibition) amendment and repealed
it by the twenty-first,
Constitutional change is an old
story to America.
The NRA decision wag unani
mous. In the AAA case, the jus
tices were divided, 6 to 3. Such
idivisions have brought up a com
' panion question of limiting the
icourt’s power, by act of congress.
} Senator James Pope, Idaho dem
ocrat, has introduced a measure
requiring at least a 7 to 2 vaote
in declaring acts of congress un
| constitutional, g
| But how far will the court go
in recognizing the wvalidity of
acte passed to limit its pp_vrgrf,'v
It is a many-sided problem, the
constitutional problem. The voters
will hear much more of it before
election day.
