(:.IZENS UNION CALLS FOR
N. Y. POLICE INVESTIGATION
NEW ¥ORK-—Does New York
Cil's Police Department need a
tho vghgeing investigation?
T cre lg a growing feeling in
sor - cuarters that it does. The
lis re¢ and intimations of
o' graft and connection with
;- org turned up by the Brook
vio -~ and jury investigation have
lor'' " ed this viewpoint.
Dvor William O’Dwyer and
his wolice officials, on the other
2rd, appearently do not agree. In
facis, the mayor and police offi
cials have been discrediting and
attacking the inquiry conducted
)y the Kings County district at
torney,
Vet, it wasn’t so long ago that!
the mayor himself showed signs:
[ uneasiness about conditions in
the department. In January, there
was a mass “shake-up” of police
inspectors in all boroughs.
Letter to Mayor
The Citizens Union, an influ
=ntial, bui cautious civic agency,
ills for an exhaustive citywide
estigation of the Police De
irtment.
n a lettter to the mayor, Milton
M. Bergerman, chairman, recom
nds the appointment of a
nromingnt person, not connected
th the department and “with a
ackground and standing to in
sbire publie confidence,” to con
uct an Investigation into con
nections between organized gam
ling and police corruption, this
' cooperation with Miles F. Mc-
Donaid, Brooklyn District Attor
ney,
“You owe it not only to the
publie, but to the department it
sell” Mr. Bergerman declares,
“since it goes without saying that
the great majority of the police
we decent men, carrying out their
dilficult and dangerous duty with
skill end fidelity.” -
_ The Citizens Union supports
\lr. MeDonald’s methods, con
vinced he is “simply doing what
fe is there for” and “is getting
somewhere.” It “deplores” the
mayor’s having “seized upon an
hdividual tragedy and turned it
o a theatrical demonstration of
disapproval of the district attor
ney’s activities.”
. Probe to Continue -
_The union refers to the suicide
of Police Captain John G. Flynn
\ller he had testified before the

Brooklyn grand jury. The police
officer left a note explaining that
his act was not a result of the in
quiry. His funeral was attended
by the mayor and by 6,000 menr
bers of the Police Department.
Unintimidated by “outside pres
sures,” Brooklyn's racket-investi
gating grand jury and its district
attorney pledged to go on with
their inquiry.
Neither the jury nor the dis
trict , attorney mentioned Mr.
O’Dwyer, but it was obvious that
their remarks referred to the
mayor’s characterization of the
investigation as a “witch hunt”
using “Hitlerian” tactics.
In Kings County Court, presid
ed over by Judge Samuel S. Leib
owitz, the grand jury foreman
handed' up a statement taking
cognizance of the “adverse criti
cism directed against its investi
gation, which criticism the grand
jury feels is not constructive.”
“Regardless of Obstacles”
“The grand jury has conducted,
and will continue to conduct, its
investigation in accordance with
its oath of office, regardless of any
obstacles placed in its way, and,
further, does not intend to be in
timidated by any outside pres
sure,” it said. ; .
The jury said it was satisfied |
with the methods employed by
the inquiry and also with the
manner in which the district at
torney’s office was ‘“performing
its duties.”
Then District Attorney McDon
ald had his inning. Obviously
deeply moved by the attacks
against him, he said he “never
expected to receive unwarranted
criticism and obstacles from peo
f)le who are sworn te uphold the
aw.”
He said he was ready to prove
that the criticism leveled at hisl
office was unjustified.
To do this, he made the “un
usual request” that the court per
mit the testimony of the late Cap
hain Flynn be released to the pub
c.
“I think that these minutes will
clearly disprove any claim that
there was any wiftch hunt or any
Hitlerian tactics used,” he said.
Judge Leibowitz took Mr. Mec~
Donald’s recomnrendation under,
advisement and will hand down*a
ruling soon. |
