otherwise improving existing
streets, thoroughfares and side
walks adjacent thereto, including
the installation of such curbing
and storm sewers as necessary to
assure adequate drainage, all for
the promotion of public communi
cation, convenience and general
weliare, bonds to- be in the de
nonrination of $1,000.00 each, num
pered 1 to 50, inclusive, dated
June 1, 1952, with interest at the
rate of two (2%) per centum per
annum, payable semi-annually on
the Ist days of June and Decem
per in each year, maturing on the
Ist day of June,
$5.000.00 in each of the years
1953 to 1962, inclusive.
The principal and interest on all
bonds of each of said issues is to
be payable in lawful money of the
United States of America at a
bank or banks to be later desig
nated.
The voting polls will be open at
seven o’clock A. M., and close at
six o'clock P. M., on the 29th day
of April, 1952, and the places of
voting shall be as follows:
First Ward—Fire Station No. 1.
Second Ward—City Hall,
Third Ward—Y. M. C. A.
Fourth Ward—Fire Station Ne.
Fifth Ward—Cody David, Inc.
Those qualified to vote at said

l. Petitioners desire, for them

name and style of EVERGREEN
MEMORIAL PARK, INC, for a
beriod of thirty-five years, -with
the privilege of renewal at expira
tion of such period.
2. The objectives and purposes
ot said corporation for which peti

operating a cemetery for the sep
ulture of the dead of the white or
taucasian race; and to acquire,

and to sell or contract for the sale
of said lots, and easements grant
ing the right of interment there
in;
(8) To have and exercise all
powers specified for like corpora
tions in Sections 22-1827 and 22-
1828 of the Code of Georgia, 1933,
as amended, and all powers con
ferred upon like " corporations by
the laws of Georgia, without lim
itation by reason of the specific
powers herein stated.
3. That said corporation be au
thorized to issue capital stock in
the total amount of $3,000.00,
same to be divided into 60 shares
of the par value of SSO per share;
with the right by action of its
stockholders at any time to in
crease the capital stock to $lO,-
000.00.
4. The amount of capital with
which said corporation will begin
business shall be $3,000.00.
5. The principal office of the
corporation shall be located in
Clarke County, Georgia, but peti
tioners desire that said corpora
tion have the power, from time to
time, as may be provided in its
by-laws, or by action of its stock
holders in accordance with its by
laws, to establish branch offices
and places of business elsewhere.
6. The names and post office
addresses of each of the petition
ers herein are as follows: Dan
Greene, 33 North Crowell Street,
Concord, North Carolina; Ben B.
Propst, 730 Wilmare Drive, Con
cord, North Carolina; J. W,
Propst, Jr., Franklin - Avenue,
Concord, North Carolina.
7. Said corporation shall be
governed, managed and operated
by a board of directors to be
elected, and to conduct the affairs
of the corporation in accordance
with the corporate by-laws.
8. Petitioners present herewith
a certificate issued by the Secre
tary of State of Georgia showing
that there is no other corporation
of the same name now in exist
ence in this state,
Wherefore, petitioners pray that
they be incorporated in accord
ance with the provisions of the
Corporation Act of 1938, under
the name and style of EVER
GREEN MEMORIAL PARK, INC,,
with all of the rights, powers,
privileges and imnrunities as are
now or may hereafter be confer
red upon like corporations under

ernors shall have full and com
plete charge of all the business
affairs and properties of said cor
poration. The remroval or surren
der of this charter, the dissolution
of the corpogation, amendments to
the charter and all other affairs,
action and business of the corpor
ation shall be decided upon, deter
mined and controlled by the said
Board of Directors, In case of dis=-
solution of the corporation, the
directors shall determine the dis
position of its assets, but in no
event shall the same inure to the
financial benefit of any director,
but such funds and properties
upon dissolution shall be used
exclusively for educational and
charitable purposes concerning the
ideal. and principles of Optimist
International.
8. That the said corporation
shall have the rights, powers, and
privileges, and be subject to all
limitations of the Corporation Act
of the State of Georgia, and the
amendments thereto, now or here
after adopted, and every provis
jon.thereof except those applying
to capital stock and stock holders
or otherwise inapplicable to the
character and purpose of this cor
poration.
WHEREFORE, petitioners pray
that they he incorporated in the
name and for the period aforesaid,
and with all the rights, powers,
privileges, provisions and condi

1. Petitioner was - incorporated
under the name and style of
Hodgkinson’s, Inc., by the Honor
able Henry H. West, Judge, Sup
erior Court, Western Circuit, on
the 10th day of March, 1950, for a
period of thirty-five (35) years,
with privilege of renewal. On
October 6, 1951, the corporate
name of petitioner was duly
changed to Beacham and Hodgkin
’ son, Incorporated.
9 Petitioner desires to change its
’name from Beacham and Hodg
kinson, Incorporated to “THE
'BEACHAM COMPANY.” Attach
ed hereto and made a part hereof
is a certificate of the Secretary of
State authorizing the use of said

3. That at a special meeting of
the stockholders of said corpora
tion held on April 4, 1952, a res
olution was duly passed directing
the officers of the corporation to
apply to this Court to have the
corporate name altered to “THE

tified copy of said resolution is

and made a part of this paragraph

that its charter be amended ac

Was Abducted
MACON, Ga., April 24—(AP)—
A negro woman told officers
Wednesday her husband was
struck with a pistol, dragged into
a car and driven away Tuesday
night by four white men and an
other negro who claimed he owed
them money, Peacock said.
The woman, Eliza Belle Burnett,
said her husband, Gordan Bur=-
nett, talked to a relative here by
telephone this morning from
Marietta and asked that she send
him sls.
Peacock said his deputies were
investigating the case today. He
said the woman swore out war=
rants charging assault with intent
to murder against a white man
and a negro, but declined to iden=-
tify the men pending their are
rest.
Assistant Solicitor General
Charles F. Adams said he author=
ized the warrants and asked the
sheriff to investigate after the
woman came to his eoffice this
morning. He said she told him she
had told Macon city detectives of
her husband’s abduction last
night, but they failed tc do any
thing about it.
Eliza Belle Burnett said her hus=-
band had worked for a construc
tion company at Marietta until
about 10 days ago when he came
home for a visit. He said he didn’t
return to Marietta because he
didn’t have the money to get
there. His boss promised to pick
him up Sunday, April 13, and take
him back to Marietta but he failed
to do so, she said.
A car drove up about 5 p. m.
and a Negro man asked where
her husband was, she said. When
she told him she didn’t know one
white man asked questions about
Gordan Burnett and then the car
left.
At about 9 p. m. the woman
said, she and her husband were
returning home when they saw a
car with three white men in it
and another white man and the
negro man waiting for them in
front of their house. She said she
offered to pay them anything her
husband owed them, but they
called him aside into the darkness.
One white man hit him in the
back of the head with a pistol and
another held a pistol on him and
forced him into their car.
