There appeared in an issue of the Ban
ner last week an account of a tight
between Judge Sam’l Lumpkin aud
Mr. I. Van Duzer, of Hartwell,
based on information given you by a
gentleman from Lexington. The state
ment was to that extent iucorreet, that

witness to the occurence: On Friday
evening, 20th September, Mr. Van
Duzer submitted to Judge Lumpkin,
then presiding in Hart Superior court,
a motion fora new trial, one of the
grounds of which was, that th« Court
of its own motion ruled out certain
evidence which w as alleged as error
against movant. The Judge declined
to approve that ground of the motion
saying that it was not true that lie ex-

the contrary. The Judge adhered to
his decision, the ground was rejected,
and with that the matter was appar-
antly at an end. Later in the evening,
after court had been adjourned for the
term, the Judge and several gentlemen*
standing in front of the hotel. Mr. Van
Duzer approached the party and asked
Judge Lumpkin if he considered the
court adjourned, the Judge saying that
he did. Mr. Van Duzer said, I demand
that you retract what you said to me in
the court house this evening. Judge
Lumpkin replied, I decline to do so,
and immediately Mr. Van Duzer struck
the Judge a glancing blow on the cheek
whereupon the Judge rushed at Mr.
Van Duzer'striking him, when both
parties were separated and there the
matter ended after a short colloquy be
tween the parties. Tho attack was
made without any other warning to the
Judge than the language quoted above
could give and was as quickly resented

No More Cotton Baling is the Latest Ver
diet— £exth Blow to New Bagging.
The Northern mills it seems are
closing down on the cotton bagging,
and the latest reports from different
cotton exchanges go to show that the
shippers everywhere are dissatisfied
with it.
A large mill iu Nexv York State re
cently declared in a letter to the Soutl -
ern agent in Savannah that the cott< n
bagging had proved a most unsuccess
ful experiment, and that the proprie
tors xvanted no more of it.
Tlie complaint was, that the cotton
cover was not sufficiently strong ir.
texture to be shipped to Liverpool
after it had been compressed. The let
ter stated that by the time the cotton
arrived in Nexv Y'ork from Savannah
and Charleston it was totally unfit for
shipping, as the cotton bugging had
not been sufficiently strong to xvith-
stand the hooks in shipping, aud that
by the time the cotton arrived in Liv
erpool it would be absolutely naked.
This is sad intelligence to the far
mers, for it makes void their boycott
against jute, since the shippers are
forced to buy it for recovering the cot
ton. It also adds to their expenses of
sending their cotton into market.
Shippers ^everywhere are makin
similar complaints to that above, and
say that tlie bagging uoxv used by tlie
farmcis is totally useless for a cover
for cotton especially if it is to he
shipped.
The farmers should look into the
matter at once and see to it that their
cotton is packed in substantial covering,
for their interest will be consulted by
so doing.

AN EAGLE SHOT.
He Had His Eye on a Baby, But Was
Brought Down by a Gun.

Rutledge,Ga., October 2.—Consider
able excitement has been created here
by the killing of an immense eagle.
The eagle xvas killed by Mr. Joel C.
Davis, who lives four miles from this
place. The eagle was sitting in a pine
tree looking intently at a six-months-
old baby of Mr. Davis.
A well directed shot brought tlie eagle
down. He measured eight feet from
tip to tip.

Fifteen prominent citizens of Mercer
county, TV. Va., have been put in jail
for lynching the negro Carter at Blue-

A Precocious Thief.

Louisville, IKy., October 3.—Geo.
Kuhn, xvho surrendered to the police
on Saturday last, and acknowledged that
he had stolen $600 from his employees
in NewjTork, left for that city yester
day in charge of an officer. Kuhn,
who is but twenty-three years of age,
xvas clerk in a large packing house in
New York, and a fexv months ago xvas
promoted to the position of cashier.
The first day after his promotion he
took all the money he could get his
hands on and ran axvay. He became
penniless here and gave himself up.

Savannah, October 3.—Samnel Sam
son tried to kill Captain James Ward,
stevedore, on Bay street, in front of the
Cotton Exchaege, at 1 o’clock. Sam
son is an old watchman along the
xvharves. He thought Ward kept him
from getting a vessel to watch last
night, and walked up to him to-day and
pulled out a pistol. Ward grabbed it.
The bullet flexv into Gramaney’s office
aud scattered the clerks. Samson’s ef
forts to kill Ward created great excite
ment. The watchman xvas arrested.
