Adam will test the le gality of the reeent recommendation of the Richmond county grand jury that the iusolvent co3ts of the sheriff, clerk and solicitors of the Superior court and city courts be paid. These insolvent costs have been paid f r years and under the recommenda tion of the grand jury the ofdcial? ap plied as usual to the county treasurer, when their claims were refused until a nice question at law can be settled. The supreme court has recently de- livered an opinion in which the pay ment of insolvent costs was declared illegal. No test case on this direct is sue has been made, but in order.to be sure and to protect both himself and bis bondsmen. Treasurer Adam prefers to have the matter legally tested and decided. Argument will, therefore, be had in the matter before Judge Roney, and the case may have to go to the su preme court for its final settlement This - question will certainly be watched with interest both by the peo ple and the officials interested.
