ATLANTA, Ga.—A decision in

Wednesday, it was announced by
Superior {Judge Bryan following
the close of arguments in the case
late Friday.
The petition was brought by Fort
Valley citizens asking Judge Bryan
to issue a writ of mandamus com
pelling Secretary of State McLen
don to certify tb the goveraor/that
the proposed constitutional amend
ment creating Peach county was
ratified in the general election in
November. It was contended that
the returns of some .60 counties
should he excluded because they
were hot made in conformity with
the law and that exclusion of these
returns would give Peach county a
majority of about ,3,000 votes.
* Secretary McLendon demurred
on the ground that exclusion of the
alleged defective returns would ba
a judicial function, which, the con
stitution does not give him per
