Judge A. W. Fite, of Carters
ville, vesterday overruled the de
murrer filed by the Southern Rail
j way 'Company to the suit of the
state of Georgia against the Sou
thern for use and occupation of
about 4 miles of the right of way
of the Western and Atlantic rail
road just this side of Dalton. The
case w 11 now be carried to the su
preme court upon this demurrer.
The* case was heard by Judge
Fite in the state library. It will
be remembered that the testimony
in this case was taken before Judge
Fite here about a month ago and
yesterday was set as the time for
hearing the argument. The argu
j ments on the side of the Southern
were presented by Colonel P. H.
Brewster, J. E, Shumate, of
Dalton, and Sanders McDaniel,
while the state was represented by
Attorney General J, M. Terrell,
Special Attorney E- T. Brown, of
the Western and Atlantic,and Hol
lins Randolph. The state’s case
was presented to the court by Mr.
Randolph.
CONTENTION IN TOINT.
The contention of the attorneys
for the Southern was that the les
sees of the Western and Atlantic
and not the state should have
brought the suit. In this connec
tion it was urged that the relation
of landlord and tenant did not ex
ist between the state and the Sou
thern, and therefore a suit for use
and occupation could not hold.
The Southern also contends that
the state, by the legislative act of
1865, ratified the possession by the
Southern of this property, it being
the successor of the Georgia Sou
thern. It was further contended
Hhat the official map of the Wes
tern and Atlantic could not be used
as prima facie evidence because the
special act so providing is void
for the reason that there is already
a general act on the subject in
question.
Mr. Randolph then presented to
the court on part of the state the
history of the alleged grant of the
use of the right of way in ques
tion. He held that the suit was
properly brought, as it was the
state, and not the lessee, that is in
terested. The state contends that
the terms of the original grant of
the use of this right of way were
never complied with for the reason
that no governor ever issued the
writ of authority provided for in
the original grant to the Dalton
and Gadsden railroad. If such a
writ of authority was granted, the
state holds it was granted to the
Dalton and Gadsden and not to its
successors or assigns. Finally, if
such grant could descend to the
successors or assigns of the Dalton
and Gadsden, it is held that it could
not be acquired by a foreign cor
poration.
The state seeks to require the
Southern to pay rental for the use
of this right of way, and through
such suit to establish its absolute
title to the property in question.
After hearing the argument on
both sides Judge Fite overruled
the Southern’s demurrer on every
point. • Colonel Brewster gave no
tice that he would appeal to the
supreme court, and the case will
go there in its order.
TRAGEDY AT MEMPHIS-
Feud Between Witnesses In Mur
der Case Results Fatally.
Memphis, Tenn., Sept. 25. —A
bloody sequel to the assassination
of Dr. H. S. Scruggs was enacted
this afternoon in front of the court
house, in which Will Humes was
Shot and killed by George W. Tur
ner. The trial of J. W. Skinner,
charged with the murder of Scruggs,
has bee.i in progress in the crim
inal court sffice Monday. Dr.
Scruggs was found in the bottom
of his buggy with a bullet through
his brain on the morning of April
18th. The theory of the state in
the prosecution of the accused is
that Dr. Scruggs was murdered
kscause of the position he had ta
ken as a member of the school
board of his distric with reference
to the suspension of certain chil
dren. There was much factional
feeling between residents and pa
trons of the school.
Many residents of the neighbor
hood have been summoned by the
state as witnesses against Skinner,
and among them was Humes.
Humes had a wife and three chil
dren, and one of his children was
suspended. The murder of Dr.
Scruggs was associated in many
minds with this school trouble.
Turner is a substantial resident
of the same vicinity. He and
Humes mutually condemned the
action of the school board. This
afternoon Turner, while walking
toward the courthouse, saw Humes
and advanced upon him. “I un
derstand you have been making in
quiries as to the color of the horse
I drove on the night that Scruggs
was murdered,” said Mr. Turner.
“It is not true,” replied Humes.
“You are a liar,” was Tur
ner’s response.
Humes then struck Turner in
the face, and the men clinched.
Suddenly four pistol shots were
fired, and Humes sank to the
street, his coat blazing from tne
close proximity of Turner’s re
volver. He was a corpse in less
than ten minutes.
Turner will make no statement,
but from all the circumstances it
is almost certain that the tragedy
will draw a flood of sensational
light upon the Scruggs assassina
tion.
