daughter, who is part owner of

“It seems like they have a
problem with people hanging
out there,” she said.
The mayor said the new
orders to officers were being
given out to officers and things
should be different.
Mrs. Daniels said getting
the right information out is the
problem. Sunday, May 31, an
officer came out to disperse the
crowd and Mrs. Daniels said
she told him the people were
not a problem. The officers
said he would check with the
chief and when he came back,
said it was OK for people to
gather at G-Nez.
“The chief is very cautious.
He wanted to make sure attor
ney Coleman was on board,”
the mayor said.
Mrs. Daniels spoke to the
City Council last week after

Mr. Coleman said if people
are found to be drinking in the
parking lot, the convenience
store could lose its beer license.
“As a result of my fact find
ing, if the pool room is open,
they are allowed to drink beer
inside,” Councilman James
Burks said.
The mayor and City
Attorney said no. The pool
room does not have an on
premises consumption license.
Mr. Eld pointed out people
have been arrested in Ashburn
before for drinking beer in the
parking lots of convenience
stores.
“If (the person) had been
drinking inside the store, it
would be the same thing,” he
said.
“If it’s an open container,
naturally they have got to take
action,” said Councilman
Major Sanders.
Councilman Cebo Bateman
took issue with that.
“Once he (the customer)
leaves out of the store, he (the
store owner) ain’t got anything
to do with that. The man is on
his own when he leaves the
store,” he said.
“They can’t do it (alcoholic
beverage consumption) on the
premises,” Attorney Coleman
replied.
‘“He’s on his own rights,”
Mr. Bateman said.
“No,” the mayor said.
“There is a whole bunch of
liability in letting people hang
out on your property that does
not involve us,” Mr. Coleman
said.
Mr. Burks asked if the prop
erty owner had a copy of the
regulations on alcohol con
sumption.
City Manager Ben Taylor
said any business with a City
beer or wine license does have
a copy of the local ordinances.
Mr. Burks asked if the busi
ness did not have one, could
they get one. Mr. Taylor said
copies of the ordinances are
available to anyone at City
Hall.
ENFORCEMENT EVERY
WHERE
Like her daughter at the
Community meeting, Mrs.
Daniels accused the Police
Department of selective
enforcement. She said officers
ran the crowds off on the west
side but did not on the east
side.
“It seems like the police are
selective at times. They want to
come and clear the parking
lot,” she said. Whereas at con
venience stores on the east side
of town, “the parking lot was
full of people. That business
was not even open.”
The mayor said the police
did disperse the crowds on the
east side of town.
“I request you do see Jim
Brooks and view the video
tape,” he said.
At the community meeting,
interim chief Brooks said offi
cers did run the crowds off, but
they returned in short order.
“What they do over there,
they need to do here,”
Councilman Sanders said.
“They are doing that,” the
mayor said.
Mayor Hedges said Mrs.
Daniels is willing to let people
gather at her place. Other busi
ness owners may not be willing
to do so.
“We’re not trying to cause
problems; we’re trying to pre
vent one,” Mrs. Daniels said.
“We do not want to get into a
fight with the Police
Department. We want the
police to be our friend.”
