Shotwell Street (NON-SECTARIAN) BE IT ORDAINED by the Mayor and Aldermen of the City of Bainbridge, and it is hereby ordained by authority of the same, that from and after the passage of this ordinance, it shall be unlawful for any person, firm or corporation to rent, or to use without rental with or with out the permission of the owner or lessee any storehouse, ware house, dwelling, shed, or build ing of any character whatever, or room in any hotel, boarding house, loffice building or any building not specifically enum erated, or to use any property belonging to himself or any mem- of his family, or to use any part of the ground, either on the surface or below the ‘surface or to use any receptacle above the ground, within the incorporate limits of the city of Bainbridge, for the purpose of concealment or storage for any alcoholic, malt, spiritous or vinous liquors, as defined by the Prohibition Act of 1907, and the Acts amen datory thereof, or any of them; the gist of the above offense be ing the rental and use alone of the premises described for the purposes ennmerated. Be it Further Ordained bv authority aforesaid, that it shall be unlawful for any person to carry on or about his pet son, or in any automobile, hack, buggy or other vehicle of any charact er, upon the public streets, side walks, alleys or parks of the City of Bainbridge, spiritous, malt, vinous or intoxicating liquors, in any quantities what soever, whether in sealed or un sealed packages, except in such cases where one has legally or dered and legally received a ship ment of said liquors, as author ized by law, and is bona fide con veying the same to his residence or legal domicile, where posses sion is permitted under the law. When one stands charged be fore the Mayor of the city of Bai bridge with the violation of any provision of this section, it shall be the duty of said Mayor to carefully inquire into all of the facts and circumstances with a view of ascertaining whether or not the defendant on trial was bona fide conveying said liqour or liquors to his legal domicle, or whether or not he was transporting said liquor or liquors on the public streets, side walks, alleys or Parks of the city of Bainbridge, with a view of violating some of the pro visions of the Prohibition Laws of the State, and the Acts amen datory thereof. The gist of the above offense being to deny the use and occupation of public, streets, sidewalks, alleys, parks etc-, of the city of Boinbridge to one who is engaged or endeavor ing to engage in a violation of any of the provisions of the State Prohibition Law of 1907, and the Acts amendatory there of, relative to sale, offers to sell, giving away or otherwise disposing of any of the prohibit ed liquors or beverages des cribed in the Prohibition Law of the State of Georgia as afore said, the offense being the use of the public property and not the violation or attempted violation of the State law itself. Be it further ordained by authority aforesaid, that any person, firm or corporation vio lating any provisions of the above and foregoing sections shall be guilty of disorderly con duct, inimical to the peace, happiness and good order of the City of Bainbridge and any per son, firm or corporation who shall be adjudged guilty of any of the above or foregoing pro visions, shall upon conviction be pumished as prescribed in Sec- 430 of the Code of the City of Bainbridge. Be it further ordained by auth ority aforesaid, that all ordin ances or parts of ordiances in conflict herewith be, and the same are, hereby repealed. J. W. Callahan, Mayor.
