In Superior Court October Term, 1924
Foreclosure Upon Real Estate.
It being represented to the court
by the petition of Henry Stevens,
that by deed or mortgage dated the
first day of January, 1924, I. D. Smith
and H. L. Smith conveyed to one \V.
M. Fussel. part of lot of land No.
97 in the Sixth District of Coffee
County, Georgia, described as fol
lows: and tine-half
(22 1-2) acres of said lot of land, ly
ing and being in the South East corn
er of said lot and being bounded as
follows: On the East and South by
.he original lines of said lot, on the
West by the dividing line dividing
said lot into east and west halves and
on the North by other lands of said

land being rectangular in shape.
It is understood and agreed that
should said property be sold, as be
low, under power of sale, the mort
gagee, his representatives and assigns
may, if he or they wish, bid and pur
chase at said sale, as any one else
might or could do.
For the purpose of securing the
payment of a ceftain promissory note
made by the said I. D. Smith and
H. L. Smith to the said W. M. Fussel
due on the first day of January, 1915
for the sum of $500.00, with interest
after date at the rate of eight per
cent per annum, which said mortgage
and the property therein described
the note and indebtedness as herein
set cut and described were all duly
transferred in writing by the said W.
M. Fussell on the eighth day of May,
1918 to Henry Stevens who is now the
true and legal holder thereof, which
said indebtedness is long past due
and unpaid.
It is orered that the said I. D.
Smith and H. L. Smith do pay in to
this Court by the first day of the
next term the principal, interest and i
cost due on said mortgage and note I
•or show cause, if any they have, to
the contrary, or that in default there
of forclosure be granted to the said
Henry Stevens of the said mortgage,
and the equity of redemption of the
said land described in said mortgage
be forever barred, and that service
of tins rule be perfected on the said
I. D. Smith and H. L. Smith accord
ing to law.

The petition of Hamp Sears of said
County shows:
1.
That he is the natural qualified'
guardian of the person and property;
of his .three minor children, to-wit: i
Stanton Sears, age fifteen; Hiram
Sears, age thirteen and Eather Seers,
age eleven, all of whom reside in Cof
fee county, Georgia, and petitioner
qualified as guardian before the Or
dinary of Coffee county, Georgia.

That he desires to sell for rein
vestment at private sale to W. H.
Bone, Jr., for the sum of $385.74 the
following property belonging to said
minors: Three-sevenths (3-7) undi
vided interest in and to all of lot of
land Nnmber 215 in the Sixth Dis
hes on the East side of Little Creek,
being all of lot number 215 except
ninety (90) acres, more or less lo
cated on the West side of Little Creek,
now belonging to Mrs. E. J. Sears, as
conveyed by deed to her by C. L. Pat
terson, dated January Ist, 1924 recor
ded in Deed Book 43, page 155 of the
Deed records of Coffee county; the;
tract herein referred to being four
hundred (400) acres, more or less,
and being the same lands conveyed by
deed from Hiram Sears to Hamp
Sears and his six children, dated May
10, 1919 an recorded in Deed book 37,
page 219 of the deed records of Cof
ffee county, Georgia.

Said lands are unimproved wild
lands located away from any road
with no timber thereon of value, and
said lands are a very poor class of
lands; that said lands are yielding no
revenue an cannot be made to yield
any revenue without the expenditure
of a good deal of money thereon to
clear and erect building thereon; that
said minors have no other property
and are totally without means to pay
the taxes on said property and instead
of said preperty yielding an income,
it is a source of yearly expense for
taxes; petitioner in his individual ca.
pacity owned the other four-sevenths
(4-7) undivided interest in said lands,
which he has already sold to W. H.
Bone, Jr., at the same ratio of value
as for the three-sevenths (3-7) inter
est, owned by said minors, now of
fered by W. H. Bone, Jr.
4.
Petitioner 'desires to invest said
money in interest bearing time certi
ficates, issued by Georgia State Bank,
not subject to check except upon ap
proval of J. L. Wall, Joe Roberts, and
L. E. Heath, or a majority thereof,
with the privilege f later investing
said money in lands which will pro
duce an income upon a like approval
by J. L. Wall, Joe Roberts and L. E.
Heath.
5.
Petitioner shows that it is necessa
ry for the Court to appoint a guar
dian ad litem to represent said minors
as provided by law.
6.
Petitioner shows that notice of his
intention to make this application has
been published once a week for four
weeks in the Coffee County Progress,
the newspaper in which County ad
vertisements are published in and for
the county,of your guardian’s appoint
ment and the County in which said
land is located, and that said minors
and next of kin have been served as
required by law.
WHEREFORE, petitioner prays
that guardian ad litem be appointed
to represent said miners, and that an
order for sale of said property for
reinvestment be granted as herein
prayed with the privileges and con
ditions set out in said petition.
