W E. the Jury, find and decree, that the Monroe Hail Road from Macon to its terminus at Marthasrille, in the -county of DeKalb, both the part thereof whigh has been completed and in operation, and the part thereof which is in an unfinished condition, and all the ptoperty, equipments, and effects therewith connected, ia subject to the payment of the debu of the Monroe Hail Hoad and Hanking Compa ny—that the said Company ia insolvent and wholly unable to pay its debts aforesaid ; and from its embarrassments is unable to complete said Hoad, and keep the game in opeia- tion. so as u> answer the great public objects contemplated by the Legialature. We find that there are creditors of va rious description of said company, vii: holders of the l ank notes issued by said Company, holders of bonds issued fur work and materials for said Road, judgment creditors, creditors holding certificates ofdepotite. demands for work! labor and materials forsaid Kail Hoad, and creditors claim ing to be mortgage creditors of said Company, and ell other creditors not lie re enumerated; and that there afe among them creditors claiming a priority of right in respect to their demands; and we further decree that the said Hail Hoad, and all the property, equipments and effects therewith con- nected.and all the properly belonging to said Company, and all the rights, privileges and franchises in any manner be longing or appertaining to said Monroe Kail Road and Han king Company be sold at public sale at the court boose in the county of Bibb, by David C.
