Mr. Hillyer then started to leave the Coart
room, notwithstanding the Jndge informed
him that the Warrant coaid not be dismissed
without the consent of the Court, and as the
Defendants were anxions that the case should
go on, he would not consent to the dismissal.
, Mr. Uillyer made no reply, but left the Court
room.
‘ * Hie Honor. Judge Smith, then directed the
Bailiff to prosecute the parties, making an
accusation against them for Assault and Bat
tery, aa there was no evidence to sustaiu the
charge of **Assaalt with intent to Murder.
The Court then adjourned until 2p.e In
m the meantime, Bryant's counsel were notified,
and Bryant subpoenaed aa a witness.
Court met again at the time appointed,
when Mr. Bryant appeared, bnt without couu-
v Ml* Mr. T. P. Westmoreland was appointed
» by the Court to appear for the prosecution.
On Mr. Bryant's coming forward to be
a worn, be stated to the Judge that this prose
cution was being carried on entirely without
his consent, it having been dismissed by his
counsel, and such being the case, be should
refuse to be sworn, unless the Court ordered
it, as it was his intention to carry the case be
fore the Grand Jury. The Court, however,
ordered Mr. Bryant to take the oath.
Some eight witnesses were examined on the
part of the prosecution, and same testimony
given as in Hon. Foster Blodgett's csss, with
the exception of Col. Atkins, who testified
that it was his impression, that at or about
the time Mr. Tweedy struck M>. Bryant, he
saw Mr. Fitzpatrick, also, strike him on the
head with a walking cane. Prof. Caldwell
testified to the same effect
The defedants culled no witnesses on their
behalf.
Tho prosecuting attorney said he shonld
abandon the prosecution sgsinst Col. Ed. F.
Blodgett, who was accordingly dircbarged.
Judge John D, Pope In a clear and deliber
ate manner, stated the points, leaving tho ar
gument t«» Judge O. A. Loclmmc.
Mr. Westmoreland argued on Lehulf of the
proseeution, but the argument was not very
convincing, nor could the thread always be
dowry followed.
^ Judge IiOchrane conducted liis argument
* with his well known eloquence, so peculiarly
Mileahin, upholding the action of Hon. Mr.
Tweedy as the conduct of a true gentleman,
and was certain his client would not hesitate
in doing the same over again, a hundred limes
if necisiity should require. He would feel
that the Irish blood iu the Honorable member
would be disgraced, did be not resent such an
insult. As to Mr. Fitzpatrick, there was no
evidence to convict him, all Hint was said as
to his striking Mr. Bryant was mere supposi
tion, and certainly could not be entortained.
The Conrt, after consideration, found Hon.
Mr. Tweedy guilty, and fined him $5 with
'costs; Hon. Mr. Fitzpatrick, guilty, and fined

Logan, and Hugh, sen oIMra B. II. Overby,
have fallen victims to the fearful disease cf
cercbro spinal meningitis. Both of tbem died
early yesterday inorniug. In all the city thcro
were uot two more sprightly lads than these
wbo have fallen in their early boyhood, and
the many friends of both families will cordi
ally sympathise with tbem in their sorrow.
This disease is one that has persistently
baflled the skill of seienoe. The best physi
cians understand very little of its pathology,
and there seems to be no regularly authorized
mode of treatment prececribed for it.
A conversation with one of the most intel
ligent, attentive and sooeeaafnl physicians in
Atlanta, creates the belief thst the disease is
a peculiar poison diffused in the blood, which
operates peculiarly npon the brain and spine.
The conviction is also produced that the exis
tence of the disease is traeeabie to unsound
and unwholesome food, which, without doubt,
is abundant in Atlanta. Corn meal is very
frequently nuaouud and nuBt for human food,
and acaroely fit for stock Bod. Meat* arc ot ten
bail, cabbage, potatoes a.id other vegetables
unfit to go otherwhere than to the pig pen.—
With sneh food offered to the people and con
sumed by them, it is qMvncdor that disease
ard death follows. 'WT
It is, nsdoabtedly, the duty of tho city sn-
thorities to look after the matter of providing
sound food for the people. An inspector
shonld be appointed at once, whose business
it is to examiuo meats, meal and vegetables
offered for sale; aod 'condemn and throw ont
of the market all that is onsonnd. As long
as merchants are permitted to sell this misera
ble stuff, they will do it, and tho people will
buy it because it is cheap, and pay for it with
their lives. The question has become purely
a unitary measure, and invclvea the. health
of the whole community; hence, its impor
tance is readily discernible. If the city au
thorities wonld act wisely, then, they will im
mediately sot about organizing some plan by
which the mnrketswtll be purged of all that is
unsound and hjgAglesome, and the people
provided wiU^^Hsood, even though it costs
tin m a few J^^Ray extra.
I n the nu jWRIE it would behoove the peo
ple to be very carefol of what they eat, and
cleanly in their habita. Let tbe ordinary diet
be well selected. The most wholesome is
good biscuits, good butter, bam and genuine
old Government Java coffee. These are only
a few sanitary limits, written at the sugges
tion of one whose wisdom and experience en
titles hiui to high rsapeert.

letter received iu this city. Tbe letter is from
a strictly reliablo party. It says:

dict ofsuieido. This is only a cover. Brant
has been cheerful in bis appearance and ex
pressed encouragement in regard to his pros

Washington, February 1.—The Mexican
Claims Commission has adjourned to the fint
Monday in June. The time required for re
butting evidence requires this long vacation.
In a case from Missouri, involving tbe lia
bility for seixure of property by officers, the
Supreme Conrt holds that n State may enact
retroactive laws, when not inhibited by it* es
tablished Constitution, and not in violation
of the provisions of the Federal Consti
tution, in relation to ex post facto legislation.
The Election Committee has finally voted to

The Senate Committee of Foreign Affairs

In tbe Honse Mr. Booker, from Virginia,
was seatod after a sharp contest.
A tariff bill has been reported. Mr. Shenck
explained that the bill was merely amendato
ry of tbe former bill. It converts Ad Valorum
into specific duties wherever it is possibla
It also includes a very large free lilt, mainly
on raw mmtorial eutering into manufactures.
The committee endeavored to bear in mind
three things, viz: Revenue, Protection and
consumption.
Mr. Brooks, opposing the Bill, said the re
dactions id the Bill had been ingeniously made
upon tea, eoffee, sugar, brandy, spiees, liquors,
Ac., thus reducing the revenue iu order to
have an excuse for raising the daty on iron,
steel, carpeting, and even old type; bnt what
was not done in the Bill was far more desirable
than what was done. Tbe objectionable fea-
tureMtood npon coal, lead, salt, lumber,
hidcJKc. Finally, after much squabbling,
the TJra was ordered to bo printed, and was
made the special order of the day for Tues
day, the 15th inst.
Tbe House considered tbe Appropriation
Bill until the hour of adjournment.

advocated a resolution, which was adopted,
looking to a mediation by the United States
for a settlement of the difficulties between

FRANCE.
Pauis, February 1.—There has born a re
markable increase of tbe small-pox within the
past few days.
The Pope has bad sn epileptic fit, bat it is
noftegarded as being fatal.
Tbe Infirmities of Age.—Decrepitude is
tbe natural accompaniment of old Age, bat it may bo
ameliorated, and the period of entire helplessness long
postponed by the judicious use of a healthful stimu
lant. Physicians, fully aware of this fact, usually re
commend moderate stimulation when the strength and
rifor of a maturity have been suspended by the fee
bleu ess and prostration which are tho inevitable re
■alts of declining jeers. Port wine, gin, brandy, and
other liquors are often prescribed by medical men
for aged persona, but the impulse which fermented
and distilled liquors give to the circulation, and the
energy they seem to impart, la transitory, unless the
alcoholic principle is modified and qualified by the
presenco of medicinal tonics and invigorants. Of all
the combinations of diffusive stimuli with the juices
oi herbs, roots and barks that hare ever been admin
istered to the aged and infirm, with the view of sus
taining their waning strength, cheering their drooping
spirits and relieving the aches and pains to which
they are subjected, none baa been found so efficacious,
ao agreeable and so permanent in its effects mm Bom-
