PETITION FOR CKARTER.
To The Honorable Secretary of State
of Georgia:

lanta, Georgia, and the address ol
each of said petitioners being Elec
tric & Gas Building, Atlanta, Geor
gia, respectfully shows:
1. That they desire to form a cor
poration under the laws of Georgia tc
operate an interurbSn railroad.
2. The name of said interurban
railroad company bliall be ATLANTA
& ANDERSON RAILWAY COM
PANY.
3. Tlie length of said railroad, as
near as it can be estimated, will be
one hundred and forty (140) miles,
of which approximately one hundred
and twenty-four (124) miles will be
located in Georgia and approximately
sixteen (10) miles will be located in
South Carolina.
4. It is proposed to construct and
operate said railroad from some poim
in Atlanta, Georgia, in a northeast
erly direction to the state line on
the eastern border of Hart county.
and thence continuing in said north
easterly direction to Anderson, S.
with all of the rights and privileges
provided by Section 2602 of the Code
of Georgia of lit 10, and with ail tin
rights and privileges conferred by
tlie laws cf Georgia upon such cor
porations, including the rights and
privileges conferred upon inter-urban
railroads by the General Assembly
of Georgia approved August lit, 1916.
f>. Said railroad, as proposed to be
constructed, will probably run
through the counties of Pulton, l)e
Kalb, Gwinnett, Barrow, Jackson,
Madison, Franklin and Hart in the
state of Georgia, and through An
derson county in the state of South
Carolina.
•!. Said railroad -will probably be
constructed through the following
•cities and towns and villages, to-vvit.
Atlanta, Decatur, Chamblee, DoraviHe
Norcross, Duluth, Hoschton, Jeffer
son, Commerce, Royston and Hart
Wr.P, in Georgia and Anderson in
South Carolina, and will probably
pass through the following political
districts in Anderson county. South
Carolina, to-wit: Savannah Township,
ihek Mill Township, Centerville
Township, City of Anderson.
7. That in the proposed construct

line of road will probably cross the
Savannah River near what is known
as Brown’s Ferry, about six and one
Hialf (6 1-2) miles in a northeasterly
direction from the city of Hartwell
in Hart County, Georgia; from
Brown’s Ferry the line will pass
through Hart county and into and
thri ugh tlie City of Hartwell on pri
vate right of way, probably crossing
tlie following streets in the Ci / of
Hartwell, viz:
Johnson, Franklin, Howell, Alford
ll.nson, Cleveland, Rodgers, Rich
art’son, Carter, Elbert, Carolina, Jack
son, Webb, Chandler, Athens, High
land, Smith, Brown and Railroad
Streets.
From Hartwell, Georgia, the line
will probably traverse Hart county
on private right of way to the City
of Royston, passing through the City
of Royston on private right of way
crossing the following named streets:
Floyd, McCrary, Lee, Bowersville,
Bermuda, Jordan, Ely, College, Park,
Tucker, Grove, Railroad, Church, Lo
cust and Cobb Streets.
Freni Royston the line will tra
verse Ftanklln, Madison and Jackson
counties. Into and through the City
of Commerce, Jackson county, on
private right of way, and will prob
ably cross the followiug streets in
the Ciyt of Commerce:
Stark, Walnut, Chestnut, Piedmont,
Green, Church, Oak, Pine, Georgia,
Ivy, Jackson, Washington, Clayton,
and North Elm Streets and Jefferson
and Central Avenues.
From Commerce the line will tra
yerse Jackson county into and
through the City of Jefferson, Jacl:-
son county, on private right of way,
crossing the following streets in the
City of Jefferson, viz:
Bridge, Storey, Gordon, Johnson
Oak, Lee, Sycamore, Mill, Railroad,
Martin, College, Washington, Hill,
Mahaffey and Church Streets
From Jefferson the line will tra
verse Jackson county into and
through the Town of Hoschton or,
private right of way, crossing the
following streets in Hoschton:
Jefferson, Bread-, Trade, High, Oak,
White, Walnut, Mulberry, Hall and
Mill Str'ets, and First and Second
Avenues.
From 110 elite n the line will tra
verse Jackson, Barrow and Gwinnett
counties into and through the Town
of Duluth on private right of way |
crossing the following streets in.
the Town of Duluth, viz:
Brewer, Hutchins, Howell, Proctor
Layvrt enceville, Knott, Fox, Graham
and Strickland Streets.
From Duluth the line will tra
v* rse Gwinnett county into anc
through the Town of Norcross on pri
vate right of way, crossing the fol
lowing streets in Norcross:
Church, Holland, Cemetery, Lively
Stone Mountain and Peachtree
Streest.
From Norcross the line will tra
verse Gvvninett and DeKalb counties
into and through the Town of Dora
ville and Cliamblee on private right
of way, crossing several roads in
said two towns, the names of said
roads being unknown to petitioners.
From the Town of Doraville the
line will traverse DeKalb county into
and through the Town of Decatur on
private right cf way, crossing the fol
iowing streets in the Town of De
catur, viz:
Oakland, Montgomery, Northern and
Fairview Streets, East Lake Drive,
Germania, Norfolk, Landsdow-ne
Drexel, Melr se, Emerson, Devon
shire, Hibernia, Hampshire and
Ponce De Leon Avenues.
From D catur the line will pass
through a part of DeKalb county on
private right of way to a connection
with Georgia Railway & Power Com
pany’s track on DeKalb Avenue, and
witli the track of the Georgia Rail
road near the south line of land lot

DeKalb county, Georgia, from wliicl
point the tracks cf the Georgia Rail
way & Electric Company and the
Georgia Railroad will be used into
the City of Atlanta, Fulton county
Georgia.

son county, Georgia, in a southwest
wardly direction through the ccun
ties of Jackson, Barrow and Gwin
nett, into and through tlie Town oi
Lawrenceville, Gwinnett county, Geor
gia, on a private right of way,
crossing the following streets in the
Town of Lawrenceville, viz:
Maltbie, Mill, Pike, Grogham
Bridge, Mechanic, Clayton and Per
ry streets.
From the Town of Lawrenceville
the said line will traverse the coun
ties of Gwinnett and DeKalb into
and through the the Town of Decatui
DeKalb county, on a private right
of way, crossing the following streets
in the Town of Decatur, viz:
Oakland, Montgomery, Northern and
Fairview Srteets, blast Imke Drive,
Germania, Norfolk,, Lansdowne,
Drexei, Melrose, Emerson, Devon
shire, Hibernia, Hampshire and
Ponce De Leon Avenues.
From Decatur, the said line will
pass through a part of DeKalb coun
ty on a private right of way to a
connection with the Georgia Railway
& Electric C’ampany’s track on De
Kalb Avenue, and with the track bl
the Georgia Railroad near the south
line of Land Lot No. 237 of the loth.
District of DeKalb county, Georgia,
from which point the tracks of the
Georgia Railway & Electric Coni
pauy and of the Georgia Railroad
will be used into the City of Atlanta,
Fulton county, Georgia.
9. The proposed term of said char
ter is one hundred and one (101)
years, with the privilege of renewal
as provided by the statutes of
Georgia.
10. The capital stock of said cor
poration shall consist of 106,286
shares of the par value of One
Hundred < %100) Dollars each, ol
which there shall be 53,143 shares of
common stock and 53,143 shares of
preferred stock, the preferred stock
j having the foiling privileges, to-wit:

Being entitled to dividends in each
year to the extent of six per cent,
1 per annum cut of the net earnings
of the company, as and when the
1 same shall be declared by the Board
of Directors of the Company, or
si.all be proper to be declared, be
fore any dividends are declared oi
paid on any other c’ass cf steck. Div
idends on the pr.-t.ncii stock. to be
cumulative and in case of non-pay
ni'i.t in any year of dividends
amounting to six per cent (6) on
faid preferred stock, the portion un
paid shall be paid cut of subsequent

t.ie common stock, but without in
tr; st on deferred payments. In
case of liquidation or dissolution of
the company, or distribution of its
capital assets the preferred stock
shall be intitled to be paid in full,
at par, after the payment of the
debts of the company and before any
payment is made on any other class
of stcck. The holders of the pre
ferred and common stock shall be en
titled to equal voting rights. The
right is reserved to the company t(
call and redeem the preferred stock
or any of it at any time at 106 per
cent, of its par value with accrued
and unpaid dividend c harges tc
date of redemption, on giving notice
cf such call thirty (30) days before
the date fixed for redemption by
mailing same to the record holders
of shares so called. The particular
shares so to be redeemed, if less
tl an all, to be determined by lot.
11. The principal office of said
corporation is to be located in lul
ten county, Georgia.
12. Petitioners show that they do
intend in good faith to go forward
without delay, to secure subscription;
to the capital stcck of said corpor
ation and to construct, equip, main
tain and operate said railroad.
13. Petitioners shew that before
tlie filing of said petition, they have
given four weeks notice of their in
tention to apply for said charter, by
the publication of this petition once
a week for four weeks in the news
papers in which tlie sheriff’s adver
t'sements are published in each oi
tlie counties through which said rail
read will probably run.
WHEREFORE, petitioners pray tc
be incorporated under said corporate
name of ATLANTA & ANDERSON
RAILWAY COMPANY, with all the
powf rs, rights and privileges grant
ed to intarurban railroad companies
undir the laws of the state of Geor
gia.
