VICTORY FOR GEORGIA In Fight Against Ducktown, Tennessee, Copper Company-High Court Ren ders Decision in Noted Case. Georgia has won its case against the Tennessee Copper company and the Ducktown Sulphur, Copper and Iron company in the United States supreme court. Dispatches from Washington Mon day morning announced a decision in the famous litigation, which has been in the courts since 1903. The opinion was handed down by Justice Beckham, who declared that if Georgia pressed the case against the copper manufacturers an injunc tion would be issued agafnst the de fendant. For over three years Attor ney General John C. Hart, assisted by Attorney Ligon Johnson, who has been associated with him in all the Intricate litigation, has rought the case for the state of Georgia. The big copper roasting plants are at Isabella ana Ducktown, Tenn.,just across the line lrom Georgia. They began smelting in 1901 and by 1902 local evidences of destruction to veg etation from the sulphur fumes ap peared. In 1903 the area of damage had spread across the Tennessee line and had appeared in the upper tier of Georgia counties. Complaints began coming to the state authorities, and the legislature of that year was pe titioned to afford relief. A legislative committee was ap pointed to investigate, and if dam ages were found as set forth the gov ernor was authorized to institute pro ceedings to abate a nuisance. The re port of the committee more than sus tained the allegations in the petition, and an appeal was made to the Ten nessee governor to estop the nuisance. On refusal, legal proceedings were instituted. At that time the ore was roasted in the open and on the promise to abandun this method, legal action was dismissed. The abatement of the trouble was not permanent, however, and further complaints came from a wider area of destruction. Since then the case has been fought in the courts until now Georgia wins finally, being given pow er to completely suppress the nui sance. Nearly 100 miles of northern Geor gia has been'* almost completely de nuded of vegetation, and many farm ers have had to practically abandon farming. This decision is expected to have far-reaching effect as a prece dent, as other cases have awaited the outcome of the Georgia litigation. Coming to the proof in the case, Justice Holmes said: “Without any attempt to go into details, immaterial to the suit, it is proper to add that we are satisfied by a preponderance of evidence that the sulphurous fumes caused and threatened damage on so considera ble a scale to the forest and vege table life, If not to human health, within the plaintiff’s state as to make a case within the 'requirement of the case of Missouri vs. Illinois. If the state adheres to its determination, there is no alternative to issuing an injunction after allowing a reasona ble time to the defendant to complete the structures that, they are now build ing, and the efforts that they are mak ing to stop the fumes. The plaintiff may submit a form of decree on the convening of this court in October, next.” CALHOUN BARS UNION LABOR. * 1 President of San Francisco Street Rail ways Draws the Lines Tightly. One hundred cars, manned and guarded by 350 non-union strike breakers, were operated in San Fran cisco Monday. President Calhoun of the United Railways made the following state ment: “I shall not take back any striking motorman or conductor, unless he first surrenders his union card, and signs a contract to remain a non-union man so long as he remains in the com pany’s employment. If any non-union men are attacked and police protec tion is not aforded, I shall exercise a constitutional right and arm them T shall not stand by and see my crews beaten up.” WATERED STOCK IS TAKEN. Full Amount of New Union Pacific Bonds Have Been Subscribed. It was announced by Kuhn, Loeb & Cos. at New York Monday that the full amount of the issue of $75,000,- 000 of bonds proposed to be made by the Union Pacific railway company has been subscribed by the members of a syndicate formed for the pur pose of underwriting the issue. The syndicate will receive such portion as is not taken by the stockholders. KIDNEY TROUBLE Suffered Two Years—Relieved in Three Month*. MR. C. B. FIZER, Mt. The Bureau of Navigation at Wash ington reports that! for the calendar year 19GG the vessels builit in Amer ica and registered numbered 1,045 of 393,291 gross tens; for 1905, 1,054 oi 300,563 gross tons; for 1904, 1,065 oi 265,104 gross tons; for 1903. 1,159 of 361,970 gross tons; and for 1902, 1,262 of 429.327 gross tons.^—Engineer.
