Ordiance.
\ BE IT ORDAINED, by the
playor and Council of the City
of Jackson that from and after
the passage of this ordiance it
shall be unlawful for any person
firm or corporation to engage in
the business of selling at retail
within the corporate limits of
said city any beverage, drink or
liquor that is a substitute, or im
itation or intended as such of
any beer, ale, wine, or liquor or
whiskey or any other spirituous,
alcoholic or malt liquor or
nearbeer or any other drink or
beverage upon which the United
States Government requires a
'tax to be paid or upon which a
revenue lisense tax is imposed un
less such firm, person or corpora
tion shall comply with each and
every condition hereafter set out
in this ordinance, to, wit:
First: Each and every firm,
corporation or person desiring to
sell any of the beverages or
drinks aforesaid, shall before en
tering into said business procure
from the Mayor and Council of
said City a business license, for
which each one shall pay for,
each license granted the sum
of fifty ($50.00) dollars per
annum, or any fractional part of
a year, the year being reckoned
from first day of January of the
year in which the license is
granted to the first day of Janu
ary of the next year, and shall
only be granted In accordance
with and subject to the condit
ions prescribed herein.
Second: Each and every per-j
son firm, or corporation wishing j
to obtain a license to sell any of
the above named drinks or bever-j
ages shall first make application.

Third: — No person, firm or
corporation will be allowed to
conduct or carry on any other
business in connection with the
sale of any of the above enumer
ated drinks or beverages and all
licenses granted are granted
subject to this condition and a
noncompliance with this condi
tion on the part of the person to
whom a license is granted shall
work a revocation, instanter of
such license.
Fourth:— There shall be no
screens, curtains partitions or
other devices to cut off the plain
view of the outside of the build
ing, in which said business is
carried on and no painted or
stained windows to the building,
but the business must be open so
: that all who are in the place of
: business can at all times be
plainly seen from the outside
and all licenses granted shall be
granted subject to this condition
and any violation of this condi
tion shall work a revocation of
any license granted.
Fifth. No person, firm or cor
poration to whom a license is
granted will be allowed to sell or
to open his place of business on
the Sabbath day nor to sell any
of said drinks or beverages to
minors and shall not keep said
place of business open later than
six o’clock p. m. on any day of
the week and all licenses granted
shall be granted subject to this
condition or regulation and any
violation of the same shall work
a revocation of the license grant
ed.
Sixth. No free lunches shall
be served with any of said drinks
or beverages, nor any article of
food shall be served free or sold

in the place of business or in con
nection therewith and any viola
tion of this condition shall work
a revocation of the license grant
ed.
Seventh. All the beverages or
drinks sold in the place of busi
ness of those to whom a license
is granted shall be plainly mark
ed or stamped or labeled with the
name of the manufacturer and
the name of the drink or bever
age so that the same can at all
times be identified and anyone to
whom a license shall be granted
violation of this condition shall
forfeit all rights under the li
cense granted and such violation
shall work a revocation of such
license.
Eighth. Licenses granted are
not transferable.
Ninth. Any person found
guilty of violating any of the
provisions of this ordinance shall
upon conviction therefor be fined
not more than one hundred dol
lars for each offense, nor sen
tenced to wdrk on the public
streets for more than thirty days
for each offense convicted of.
Tenth. Anyone convicted of
violating in of the provisions
of this ordinance or any person,
firm or corporation to whom a
license has been granted failing
to comply with any of the regu
lations hereof shall upon convic
tion thereof in the Mayor’s court
forfeit all rights and privileges
incident to said license and the
conviction of said court shall
work a revocation of any license
granted and the same shall be
operation of this ordinance be
void.
Eleventh. Any person found
guilty of carrying on or selling
or conducting a businesss of sell
ing any of the above named
drinks and beverages without a
license granted as aforesaid or
selling or offering for sale any of
the same after the license grant
ed them has been revoked shall
upon conviction thereof in
Mayor’s court be fined not less
than one hundred dollars and
sentenced to work on the streets
of said city not less than sixty
days.
Twelfth. Any person convict-

ed of keeping in said place of
business any liquor, whiskey,
or other intoxicating, spirituous,
or alcoholic liquor which when
drunk to excess will produce in
toxication, for the purpose of il
legal sale, shall thereby forfeit
all rights and privileges granted
under such license and the said
conviction shall work a revocation
of said license.
