By virtue of an order form the
Court of Ordinary of Butts County,
Georgia, will be sold, at public out
cry, on the first Tuesday in April.
1934, at the court house in said
county, between the legal hours of
sale, the following tract of land in
said county, described as follows:
“All that tract or parcel of land
lying and being inthe City of Jack
son, and described as follows: One
house and lot in the city of Jackson,
Georgia, Butts County, said lot con
taining "u of an acre of land, more
or less, and bounded as follows: On
the north by lot of G. W. Kinsman;
on the east by lot of Mrs. Nackie
Gray; south 'by Mrs. Nackie Gray

974-B—COUNTY OF BUTTS
AND MONROE.
Sealed proposals will be received
by the State Highway Board of Geor
gia at the General Office at No. 2
Capitol Square, Atlanta, Ga., until
10:00 A. M., Central Standard time,
March 22nd, 1934, for furnishing all
labor, material, equipment and other
shings necessary for the construction
of 11.822 miles of paved road locat
ed in Butts and Monroe counties on
what is locally known as the Forsyth-
Jackson road. Beginning 4 miles
north of Forsyth and ending at In
dian Springs, otherwise known as
State Aid Project No. 970-A&B and
974-B in Butts and Monroe counties.
The work will be let in one contract.
The Approximate Quantities Are as
Folows:
124822 Sq: Yds. Concrete paving.
18000 Cu. Yds. Common and bor
row excavation.
68000 Sq. Yds. Grassing si opes
and shoulders.
95000 Sq. Yds. Finishing and
dressing.
Said work shall begin within ten
(10) days after award of contract
and shall be completed within 120
working days. The State Highway
Department shall in no way be bound
or obligated by any bid or award un
til the execution of a formal written
contract by the State Highway
Board. When such contract has
been executed, written notice shall
be given the Contractor, at which
time, and not befove, work may be
commenced. *

tract will not create liabiliy, express
or implied against the undersigned
members of the State Highway
Board, as individuals, either sepa
rately or collectively, nor against any
employee of the State Highway
Board or the State Highway Depart
ment, in his or her individual ca
pacity.
Plans and specifications are on file
at the office of the undersigned at
Atlanta and Macon, Ga., and at the
office of the Board of County Com
missioners of Butts and Monroe
counties at Jackson and Forsyth,
Georgia, where they may be inspect
ed free of charge. Copies of the
plans may be obtained upon payment
in advance of the sum of $lO. Copies
of the General Specifications may be
obtained upon payment in advance
of the sum of SI.OO, which sums will
not be refunded except to the suc
cessful bidder who will be furnished
a complete set of plans and specifi
cations free of charge.
Upon compliance with the require
ments of the Standard Specification-
Ninety (90) per cent of the amount
of work done in any calendar month
will be paid for between the 10th
and 15th day of the succeeding
month, and the remainder within
thirty (30) days after final comple
tion and acceptance. Proposals must
be submitted on regular forms which
will be supplied by the undersigned
end must be accompanied by a cer
tified check, Cashiers’ Check, or ne
gotiable United States Bondi's in the
amount of $10,000.00 and must be
plainly marked “Proposals’ for Road
Construction” County and Number
and show the time of opening as ad
vertised. Check of the low bidder
will be cashed and all other checks
will be returned as soon as the con
tract is awarded, unless it is deemed
advisable by the State Highway
Board to hold one or more checks.
If an unusual condition arises, the
State Highway Board reserves the
right to cash all checks. Bidders
Bond will not be accepted.
Bond will be required of the suc
cessful bidder as required 'by law
The bond must be written by a li
censed Georgia Agent in a company
licensed to write Surety Bonds in the
State of Georgia, and be accompa
nied by a certificate from the De
partment of Industrial Relations that
the Contractor is complying with the
Georgia Workmen’s Compensation
Act.
Contracts will not be awarded to
contractors who have not been placed
on the list of qualified Contractors
prior to the date of award. No pro
posals will be issued to any bidder
later than 4 P. M., Central Standard
time of the day prior to the date of
opening bids.
Every contractor applying for pro
posals must submit at the same time,
on a form which will be supplied by
the undersigned a statement of his
contracts on hand.
All bids must show totals for each
item and total of amount of bid.
Right is reserved to delay the award
of the contract for a period of not
to exceed thirty (30) days from the
date of opening bids. Right is re
served to reject any and all bids and
to waive all formalities.

TO AMEND CHARTER
State of Georgia,
County of Butts.
To the Superior Court of raid
County:
E. L. Smith, H. M. Moore and T.
B. Smith respectfully represents t<>
the Court, as follows:
1.
That heertofore, 6n the 13 day of
January, 1923, “Etheridge-Smith
Company” was duly chartered a cor
poration by the Superior Court of
Butts County, Georgia.
2.
That the petition and judgment of
the Court chartering said corporation
is recorded in Charter Book, No. 2#
pages 1 and 2, in the office of the
Clerk of Butts Superior Court.
3.
That is is provided in pai’agraph
7, of said petition for incorporation,
that amendments to the charter could
be- applied for and accepted by a
majority vote of its stock outstand
ing at the time the amendment is
applied for.
4.
That at the stock holders meeting
of said corporation held at its office,
in the City of Jackson on the 8 day
of February, 1934, at which meeting
a majority of the stock outstanding
was represented, it was unanimously
voted to apply for and accept an
amendment to said charter, as fol
lows:
Paragraph 4 of said charter is
amended by striking therefrom the
following:
“That the capital stock of said
corporation shall be Fifty Thousand
Dollars ($50,000.00) with the priv
ilege of increasing to the sum of
One Hundred Thousand Dollars
$100,000.00) by a majority vote of
the stock holders” and inserting
therein and in lieu thereof the fol
lowing:
“That the capital stock of said
corporation shall be Ten Thousand
Dollars ($10,000.00) with the priv
ilege of increasing it to the sum of
Fifty Thousand Dollars $50,000.00)
or any portion thereof by a majority
vote of the stock holders.”
Attached hereto is a certified ex
cerpt from the minutes of said stock
holders meeting, marked Exhibit
“A.”
Whrefore, petitioners pray that
said amendment be allowed and
granted by proper order of the court,
after same has been published as re
quired by law.

stock holders meeting of Etheridge-
Smith Company held on the 8 day
of February, 1934.
“Motion by T. B. Smith, seconded
by H. M. Moore; That an amend
ment to the charter be applied for
and accepted, reducing the capital
stock from $50,000.00 to $10,000.00,
and the privilege of increasing same
to $100,000.00 be reduced to $50,-
000.00 or any poi'tion thereof by a
majority vote of the stock holders,
was unanimously adopted by a ma
jority of the stock outstanding.”
