By virtue of power of sale in
warranty deed with power of sale
executed and delivered by Mrs.
Dixie Preston to Etheridge-Smith
Smith Company, dated May 11,
1934, and recorded in deed book
No. 6, page 429, in the office of
the Clerk of Butts Superior Court,
there will be sold by Etheridge-
Smith Company as attorney in fact
for Mrs. Dixie Preston, at public
outcry in front of Butts County
Courthouse, within the legal hours
of sale, on the first Tuesday in Feb
ruary, 1949, to the highest bidder
for cash, the following described
real estate, to wit:
A tract or parcel of land lying
and being in Iron Springs District
G. M. of Butts County, Georgia, con
taining 48 acres, more or less and
bounded as follows: On the north
by lands of Mrs. Eula Thomas, on
the east by lands of R. H. Hender
son and Mrs. Annie Lemon, on the
south by lands of T. W. Higgins
and on the west by lands of Mrs.
Dixie Preston.
Also all that tract or parcel of
land lying and being in 552nd., Dis
trict G. M. of Butts County, Geor
gia, containing 95 acres, more or
less, and bounded as follows: on the
north by lands of J. L. Bailey, on
the east by lands of Mrs. W. M.
Bledsoe, on the south by lands of
W. M. Bledsoe and on the west by
lands of Mrs. Eula Thomas.
Also all that tract or parcel of
land lying and being in the 552nd.,
District G. M. Butts County, Geor
gia and containing It acres, more
or less, and joining the above de
scribed tract on the north-east cor
ner and bounded as follows: on the
north by the mill property and
lands of formerly S. B. Kinard and
J. B. Carmichael, on the cast by
public road known as Watkins Mill
Road, on the south by lands of Mrs.
W. M. Bledsoe and on the west by
lands of J. L. Bailey.
The debt secured by this deed be
ing in default, said sale will be made
for the purpose of paying same and
the proceeds thereof will be applied
to the payment of principal and in
terest due on said debt and the
expenses of this sale, and the sur
plus, if any, will be turned over
to Mrs. Dixie Preston.

APPLICATION TO REVIVE
CHARTER
STATE OF GEORGIA,
COUNTY OF BUTTS:
To the Superior Court of said county:
JACKSON ICE CORPORATION
respectfully shows unto the Court
the following:
1. That it was duly granted a
charter by this Honorable Court on
the 30th day of October, 1919,
which thereafter was duly amended
on the 10th day of February, 1932.
2. That by authority of said in
corporation, it has continued in bus
iness and is still doing business in
its corporate name.
3. That its charter, as amended,
expired by operation of law on the
30th day of October, 1939, without
renewal thereof, and it has contin
ued as such corporation in ignor
ance of said expiration.

vided by law, it presents this its pe
tition praying that its charter as
amended be revived, effective from
the date of the expiration of its
previous charter, to-wit: October
30th, 1939.
5. That said incorporation was
for the purpose of doing business in
the manufacture and sale, at whole
sale and retail, of ice, to buy and
sell coal, wood, and other products,
to have and maintain a cold storage
plant, handle dairy products, and
such allied lines as in the discretion
of its directors may seem advisable;
the principal place of business and
office being in Jackson, said State
and County.
6. That the authorized capital
stock is $30,000.00, to be issued in
shares of the par value of $5.00
per share, the number of shares and
the amount of stock to be issued to
be determined by a majority of the
stockholders
7. That it desires that its said
charter, as amended, be revived for
another period of 35 years, effect
ive from the expiration of its pre
vious charter, as aforesaid, and
that to this end, at the regular an
nual meeting of the stockholders on
the 10th day of January, 1940, at
which a majority of stock was rep
resented in person or by proxy, and
of which all stockholders had writ
ten notice; and that at said meet
ing all of the stock present voted
for reviver of the charter, which is
shown by an extract of the min
utes, duly certified and hereto at
tached.
8. Wherefore, JACKSON ICE
CORPORATION, petitioner, prays
that its said charter be revived and
extended for a period of 35 years
from October 30th, 1939, with the
privilege of renewal, and that it
have all the benefits and be subject
to all the liabilities prescribed by
the laws of Georgia for corpora
tions of its kind.

Regular annual meeting of the
stockholders of the Jackson Ice
Corporation, January 10, 1940.
Whereas, it appears that the
charter of Jackson Ice Corporation,
together with all amendments there
to, expired by operation of law on
Qctober 30, 1939, and that said
corporation has continued in busi
ness in ignorance thereof;
And, whereas, notice of intention
to submit the question of reviver of
said charter and all amendments
thereto to this regular annual meet
ing of the stockholders was duly
given 10 days prior to this meeting;
And, whereas, it appears to be
the unanimous opinion of the stock
holders of said corporation that it
should revive its charter with all
amendments thereto, the corporation
being solvent and enjoying a satis
factory business and there being no
desire to discontinue business.
Therefore, be it resolved, by the
stockholders of Jackson Ice Corpora
tion, in annual meeting, this Jan
uary 10, 1940, that the charter to
gether with all amendments thereto
of Jackson Ice Corporation be reviv
ed and that the president of the
corporation be empowered, instruct
ed, directed and authorized to pro
ceed immediately in the name of
Jackson Ice Corporation to revive
said charter and amendments in com
pliance with law and the statue per
taining to the reviver of charters
and he is authorized to take such
steps in so doing as the law re
quires.
On motion of R. P. Sasnett, a
stockholder, seconded by H. R. Sla
ton, a stockholder, the foregoing
resolution was unanimously adopt
ed by all those present, they con
stituting a majority of the stock
holders of the corporation.

certify that the above and foregoing
is a true and correct copy of an ex
tract from the minutes of the an
nual stockholders’ meeting of Jack
son Ice Corporation, held January
10, 1940.

ORDER OF REVIVER
JACKSON ICE CORPORATION,
a corporation originally chartered by
this Court 30th day of October,
1919, its charter having been
amended on the 10th day of Feb
ruary, 1932, having duly petitioned
the Court for a revival of its said
charter which expired by operation
of law on the 30th day of October,
1939, for another period of 35
years, said corporation having con
tinued in business as such since ex
piration date, in ignorance thereof,
and a majority of stockholders hav
ing voted at the regular annual
meeting, after written notice of the
purpose of the meeting, for a revi
val of its charter, and all other con
ditions having been complied with,
it is adjudged, ordered and con
sidered that the charter of said cor
poration be revived from said ex
piration date for a period of 35
years, subject to all the liabilities
prescribed by the laws of Georgia
and enjoying all the benefits there
of; all acts of said corporation for
its benefit and against its interest
in the expiration period being here
by declared binding and of full
force, as valid acts of said corpora
tion. Let citation issue in terms of
law.

James W. Benson
Dies In Waco, Tex.
Mr. James W. Benson, a former
widely known Butts county resi
dent, died at his home in Waco.
Texas, Tuesday morning, January
9. He suffered a heart attack which
proved fatal. He was 67 years of
age and was the only son of the
late Marshall A. and Roxie Bishop
Benson, prominent Butts county
citizens.
Mr. Benson, formerly actively in
terested in businss affairs here, left
Butts county several years ago and
had resided in Texas. He was one
of the organizers of the Farmers
Bank at Jenkinsburg and was con
nected with other business interests.
Rites were held Thursday after,
noon and burial was in the Waco
cemetery.
He is survived by his wife, the
former Miss Sadie Lewis, of Mc-
Donough; eight sons, C. W., of For
syth, J. A., of Smarrs, Sam, of Ma
con, E. S., of Two Butte, Col., L. P.
of Houston, Texas, Walter, Lewis
and Robert, of Waco, Texas; five
daughters, Mrs. A. H. Pritchett, of
Smarrs, Mrs. T. G. Carter, of Mt.
Calm, Texas, Misses Ruth, Marjorie
and Laynie Benson, of W’aco; one
sister, Mrs. Walter S. White, of
Jackson.
RITES FOR MRS. WILSON
HELD AT SARDIS CHURCH
Funeral services for Mrs. Agnes
C. Wilson, 89 years of age, who died
at her home in Atlanta Thursday,
were held at Sardis Baptist church
Friday afternoon at 2 o’clock. Rev.
Z. E. Barron officiated and burial
was in the churchyard.
Mrs. Wilson, the former Miss
Agnes Ragan, was the widow of the
late Mr. Milton Wilson, and had
resided in Atlanta for the last
twenty years.
She is survived by one son, J. M.
Wilson, and one step-son, J. T. Wil
son.
