a note for $57,000.00 (Fifty
seven thousand & no-100
Dollars), payable to Mildred
E. Fears, which note with
interest thereon, at the rate
of 7 percent per annum, was
payable in twelve (12)
installments as follows:
1. On or before December 21,
1972 the accrued interest
upon this promissory note
shall be due and payable and
shall be paid on or before
December 21, 1972.
2. On or before the 21st day of
December 1973 the accrued

note shall be due and payable

3. On or before the 21st day of
December 1974 the sum of

11. On or before the 21st day
of December 1982 the sum of
$5,700.00 shall be due and
payable upon the unpaid

said promissory note shall be
due and payable on or before
December 21, 1982.
12. On or before the 21st day
of December 1983 the sum of
$5,700.00 shall be due and
payable upon the unpaid
principal balance: and, in
addition thereto all accrued
interest upon the outstanding
unpaid principal balance of
said promissory note shall be
due and payable on or before
December 21, 1983, which
shall be the final and last
installment upon this note.
These installments shall
begin on December 21, 1972,
and continue thereafter on
the same day of each
succeeding year, with a final
payment on December 21,
1983, each payment being
applied to the interest then
due and the balance to the
reduction of the principal
amount, interest being com
puted on the unpaid princi
pal. Time was made the
essence of the contract, and
the note contained a provi
sion for the payment of 10
percent of the principal and
interest as attorney’s fees, if
collected by law or through
an attorney at law. In order
to secure the payment of said
note, Michael E. Halpern
executed and delivered to
Mildred E. Fears a deed to
secure a debt, conveying the
following described land:
ALL that tract or parcel of
land situate lying and being
in the 609th G.M. District and
the 614th G.M. District, Butts
County, Georgia consisting of
Two Hundred (200) Acres of
land, more or less, located
about one-half (%) mile
South of the City Limits of the
City of Flovilla, being
described as per a Plat of
Survey, prepared by J.
Wayne Proctor, Sr., a
Registered Surveyor, No.
1328 of Barnesville, Georgia
which Plat is recorded in
Plat Book 3, Page 145 in the
Office of the Clerk of the
Superior Court of Butts
County, Georgia and by
reference the said Plat is
made a part of the
description of said tract of
land herein recited:

February 24, 1976 of

ney’s fees thereon.
The said deed contains a
power of sale, authorizing the
grantee, as attorney in fact
for grantor therein to sell the
property conveyed thereby in
order to satisfy said note, as
well as subsequent advances,
after advertising the same
once a week for four weeks in
the official gazette of said
County, and in accordance
with said power of sale and
by virtue thereof the Grantee
will sell the property above
described at public outcry to
the highest and best bidder
for cash, on the First
Tuesday in April 1976 at the
place of public sales before
the Courthouse door in Butts
County, Georgia, and within
the legal hours of sale.

On the 17th day of June,
1965, Clifford Johnson exe
cuted a Promissory Real
Estate Note for $5,800.00,
payable to Newton Federal
Savings & Loan Association
of Covington, Georgia, with
interest thereon, which Note
was payable in monthly
installments of $43.25 per
month, beginning on the first
day of July, 1965, and,
continuing thereafter on the
first day of each succeeding
month, with the final
installment being due and
payable on the first day of
June, 1985. Each payment
being applied to the interest
is due, and. the balance being
applied to the reduction of
the principal amount, the
interest being computed on
the unpaid principal balance.
Time was made the essence
