NOTICE OF SALE
UNDER POWERIN DEED
TO SECURE DEBT
On the 25th day of July,
1975, FLOYD E. POWELL
executed a real estate Note
for the principle sum of Six
Thousand Dollars ($6,000.00)
to ROBERT L. FENDLEY,
of Route Two, Cleveland,
Georgia, which Note with
interest thereon at the rate of
8 percent per annum was
payable in monthly install
ments of $72.80 each,
beginning on the 25th day of
August, 1975, and continuing
thereafter on the same day of
each succeeding month, with
the final and last installment
being due and payable on the
25th day of July, 1985, each
payment being applied to the
interest then due, and the
balance to the reduction of
the principle balance. Time
was made the essence of the
Contract, and the said Note
contained a provision for the
payment of 10 percent of the
unpaid principle and interest
as Attorney’s Fees if collect
ed by Law or through an
Attorney at Law. In order to
secure the payment of said
Note, the said FLOYD E.
POWELL executed and de
livered to ROBERT L.
FENDLEY a Second Deed to
Secure Debt, conveying to
him under said Second Deed
to Secure Debt, the following
described tract of land, upon
which the FULTON FED

ASSOCIATION, a Corpora
tion, of Henry County,
McDonough, Georgia holds
the First Lien, and-or Deed to
Secure Debt, and being

Butts County, Georgia, with
all the improvements there
on, in Land Lot 249 of the Bth
Land District of Butts
County, Georgia, consisting
of 1.88 acres, more or less,

Because said FLOYD E.
POWELL defaulted in mak
ing payments of the monthly
installments as they matur
ed, ROBERT L. FENDLEY,
pursuant to the provisions of
said Promissory Note and
Second Security Deed, as
aforesaid, securing the,
same, has exercised his
option and declared the
entire balance due and
collectible. Notice fixing the
liability for Attorney’s Fees
has been given according to
Law. There is a balance as of
the 30th day of June, 1977 of
$5,505.00 besides interest and
Attorney’s fees thereon.
The said Second Deed to
Secure Debt contains a
Power of Sale authorizing the
Grantee ROBERT L. FEND
LEY, as Attorney in fact, for
said Grantor, therein, to sell
the property conveyed there
by. in order to satisfy said

ment will be made to the
contractor each calendar
month based on the estimat
ed work complete in place as
prescribed by the Standard
Specifications. Retainage as
prescribed by the Standard
Specifications will be with
held. Retainage may be
deposited in escrow accounts
at the option of the
Contractor. Final payment of
amounts withheld or deposit
ed in escrow will not be made
until the State Highway
Engineer has certified that
the work has been satisfac
torily completed and accept
ed.
Projects financed' with
Federal funds will contain
provisions with regard to
equal employment opportu
nities, minimum wages,
employment of labor, meth
ods of construction, minority
business enterprise involve
ment, and subletting or
assigning the contract. On
such projects the Depart
ment will insure that
minority business enterprise
contractors will be afforded
full opportunity to submit
bids in response to this
invitation and will not be
discriminated against on the
grounds of race, color, or
national origin in considera
tion for an award. On such
projects all bidders must
certify and document that
potential minority business
enterprise subcontractors
have been contacted and that
their interest, capabilities,
and prices have been
affirmatively solicited.
Any federally financed
work located within the
counties of Fulton, DeKalb.
Cobb, Clayton and Gwinnett,
the estimated cost of which
exceed $500,000.00 will be
subject to the requirements
of the Atlanta Plan. Require
ments of the Atlanta Plan
will be included in the
contract special provisions
where applicable. Copies of
the Atlanta Plan are avail
able from the same source as
plans and proposals.
This advertisement is
merely an invitation for the
submission of bids w-hich are
to be considered as offers for
performance of work by the
submitting party. The state
reserves the right to reject

The Department reserves

Keeping Records. What to
Discard, is a free pamphlet
that's true to its title. For
your copy of Keeping
Records. What to Discard,
just send a postcard to the
Consumer Information Cen
ter. Dept. 625 E. Pueblo,
Colorado 81009.
First of all. you don’t need
to keep all cancelled checks.
It’s important to keep the
checks and receipts that may
be needed for income tax
purposes. The Internal Re
venue Service has three
years in which to audit
Federal income tax returns.
However, this limit doesn't
apply in unusual cases. If you
failed to report more than 25
percent of your gross
income, the government has
5 years to collect the tax or
start legal proceedings.
There are also no time limits
if you filed a s proved)
fraudulent return or if you
failed to file a return. Time
limits for State income taxes
vary, so you'll want to find
out w hat the law says in your
State.
Its important to keep your
irreplaceable papers in your
safe deposit box—they in
clude marriage and birth
certificates, divorce and
adoption papers, citizenship
records, service papers, and

records, bank books, social
security cards, guarantees,
burial instructions, or old
love letters. Remember that
copies of some things can be
replaced rather easily—co
pies of insurance policies can
be obtained from your
insurance companies. Copies
of cancelled checks are
usually available at your
bank
The original copy of a will
is usually kept in the safe of
the attorney who prepared it.
This can save you complica
tions later on. The client
receives the two carbon
copies, one of which may be
put in the safe deposit box.
Since there could be a legal
delay in getting this copy
after the death of the person
involved, the third copy
should be kept at home where
it is readily accessible.
One very important record
is your household inventory.
For this to be of value in case
of fire or burglary, you'll
need to supply some detail.
Be sure to list the item, date
bought, purchase price,
model number if it applies,
brand name, dealer's name
and general description.
Some families take pictures
of their rooms to help identify
possessions. Keep this docu
ment in your safe deposit box
too. give a copy to your
insurance company and keep
one at home.
