The following is the bill passed at tbi* recent session of the legislature pnivi ling for a dispensary in Fort < i.tines; AX ACT T<* establish, maintain and regulate a Dispensary in the town of Fort 'Gaines, Clay county, Georgia, for the «ale of ardent spirits, malt liquors, wines, cider and other intoxicants, and to establish and perpetuate a Hoard of Commissioners forthe man¬ agement of said dispensary,and other purposes. He it further enacted. ’I'hat the Dispensary Commissioners piwidetl for in this Act may maintain, at some convenient point in the town «>l rort (iuhh'x, within \hv tiri*. limits, h Dispensary for the sale of spirits, malt liquors, wines, eider and oth**! - intoxicants. They shall *m the «lay alter their ({iialilicatioii, organiza- 1 ion and initially thereafter elect a man who slnill he of good moral character and sober habits to in* known as the Dispensary Manager, who shall have charge and control of said Dispensary under their supervision. Said manager tdiall be chosen for the term of one year, but shall be removable at any time, by said Commissioners, for neg- lent of duty, or violation of any law, ami said Commissioners shall till his place al once. Said Dispensary Maua- ger shall be required to lane and sub- scribe an oath, that he will faith- fully and honestly discharge al^ duties required of him In this Act. Said Dispensary Manager shall also be required to give bond with good seen- my to he approved by the Hoard ot Cemmissionors, in such sum as the Hoard nay determine, conditioned to faithfully account for all goods and moneys that may come into his hands as such manager, and tor the faithful performance of all duties required of him by this Act and by such rules and regulations as the Board of Commis- shmers may fix, am! his sation shall not he dependent upon the umount of his sales. Said man- ager shall sell only for cash and shal^ tuni over all money* received by lnm to tiie Secretary of the Hoard each day^ who shall keep an account of the *nm< and who fdiall turn over to the J re as* urer of the Board of Commissioners at the. expiration of each week taking said Treasurer's receipt for the same. Section 4. Be it further enacted, That said Dispensary (Commissioners shall make, from time to time, rules and regulations for the operation of said Dispensary not in e<»ntlicl with the provisions of this Act. The quan- tity of liquor to lie sold to any one per- son at one time shall not exceed four gallons, and in no event shall liquors be furnished in quantities less tlian half pints, and none shall he drunk in the building or on the premises where said Dispensary is located. Said Dis- pensarv shall not be opened before sunrise and be closed each day before sun set. and remain closed on Sundays, elect in days, and such other days as the Commissioners may direct. Said manager shall he bound by all the laws of this State regulating the sale ot liquors, and all the regulation* of said Hoard of Commissioners not w ith the laws of tins State. Section .1. licit further enacted That the manager of said Dispensary shall sell to no person or persons any of sail! ardent spirits, malt liquors, wines, eider or other intoxicants ex¬ cept iti sealed packages, and he shall not keep any broken packages in said Dispensary, and whenever an original package is broken, it lie at once hot11***1 and sealed. Saul manager shall make a monthly report to said Commission- ers, showing the aniouqt of sales for the preceding mouth and stock on hand on the last.lav of said month, Said Commissioners may cause, an in- spection and an analysis of the stock on hand, from time to tune, bv a <om potent chemist the expense of which to be paid out of any funds in the hands of he. He it further enacted,, said Hoard of Commissioners shall appropriate a sufficiency of the ! net profits of said Dispensary not to exceed fifty percent, thereof to main- tain the. Twenty-five dollars each per annum and the Secretary and Treasurer shall lie paid £nch Twenty-five dollars per annum additonal, said salaries to lie paid cut of the net proceeds of the Dispensary. Section 11. Be it further enacted* fhat said Board of Commissioners shall have full now -r and authority at any time tliev deem it for the best in- tercet of said Umn of Fort Gaines to Miqwnd or discontinue said Dispen- sary by cloning out all stock on hand, Section 12. Be it further enacted, That, on and after the passage of this Act, the titj- Council of Fort (Jaincsis hereby prohibited from issuing, grant* i Ils r or r j uewing any license for the sale 0 f anient spirits, malt liquors, wines^ cider and other intoxicants within the corporate limits of said town of Fort Gaines, provided, nevertheless, that should the Dispensary Commissioners at any time determine to permanently discontinue the Dispensary as author- i 7<( .,i j t , the 11th Section, then the City Council of Fort Gaines are here- authorized to resume the control t), c ijquor tratlic in said town, Section HI He it further enacted, That all laws and parts of laws in con- tli*-t with this Act Tie and the same are hereby repealed.
