ORDINANCES
OF THE
TOWN OF CHAUNCEY >
ADOPTED FEB. 10, 1887.

MAYOR.
Section 1. It shall be the duty of
the Mayor to hold his courts as often
as he may think necessary, and shrill
have cognizance of all offenses against
the ordinances of said town with pow¬
er to Inflict a proper punishment by
fines or imprisonment, or other penal¬
ty prescribed by the ordinances of said
town, from time to time ; shall approve
all claims for work done or material
furnished for streets in said town; and
said court shall have power to fine or
commit to jail any perse n or persons
who may in any manner disturb said
court during its sittings, or in any
manner be in contempt of its authori¬
ty ; and in his absence or disqualifica¬
tions said duties shall he performed by
Much Aldermen as shall be designated
by the council; and to preside at all
meetings of the council, and to call
meetings of the council when in his
opinion the interests of the town re¬
quires it.
2d. The Mayor shall keep a docket
of all cases tried by him, showing the
disposition of such case.
ALDERMEN.
3d. It shall he the duty of the Alder¬
men to meet at the council for the pur¬
pose of transacting any business re¬
lating to the interest of the town or its
citizens, and to serve upon such stand¬
ing and special committees a? they
may be placed.
CLERK AND TREASURER.
4th. It shall be the duty of the Clerk
and Treasurer to attend all meetings
©f the council and to keep a minute of
all the proceedings, and to issue all
licenses,, notices, writs and processes
required by the Mayor, council and the
ordinances aud laws relating to said
town.
5th. He shall keep a tax l>ook in
which shall be entered as received
from the tax payers,, all property sub¬
ject to taxation at its true market val¬
ue, with the party’s name aud amount
due thereon, and collect the same in
accordance with tivc ordinances ot the
town.
0th. He shall keep a book in which
shall bo entered the different amounts
of money received, who from and for
what purpose—keeping the street fund
separate from the general funds, and
shall not pay out any funds except up
on orders drawn upou that fund, and
then according to their dates, unless
there is sufficient to pay all orders.
7th. He shall keep a book in which
shall be entered a statement of all ex
ccutions and processes issued, against
whom, when, amount aud for what
purpose. the marshal 5
8th. He shall furnish
days before any street working, a list
©f all parties subject to street duty.
9th. He shall keep a book in which

10th. He shall make a written re¬
port at the end of each quarter to the
finance committee, which shall be act¬
ed ui>on and then published in the pa¬
per doing the official advertising of
said town.
MARSHAL.
11th. It shall be the duty of the mar¬
shal to arrest all parties violating the
ordinances of the town or the penal
laws of the State, to coniine them in
jail until the Mayors court,unless good
bond is given for their appearance be¬
fore said tribunal; to appear at said
court with all the evidence within his
knowledge establishing the guilt of
the accused; to execute all warrants,
processes, writs or notices placed in
his hands by the Clerk and Treasurer,
Aldermen or Mayor, and to wear a
star indicative of his authority. lie
shall farther have power and authori¬
ty to summon a posse of the citizens
of said town in case it be necessary to
enforce any of the ordinances; and in
case they fail or refuse to obey said
summon, he shall report all who re¬
fuse or fail to act, to the Mayor. It
shall be his duty to visit the public
streets and highways in said town at
least once in each forty-eight hours,
and remove any nujsance or anything
that worketh hurt, inconvenience or
damage affecting the health, the mor¬
als or the safety of the town. He shall
have power and authority to enter any
enclosure, house, store or other build¬
ings, for the purpose of performing his
duty. He shall suppress any assembly
engaged in boisterous, drunken, riot¬
ous or unlawful acts of any kind,
whether under the name of balls, par¬
ties or frolics.
11th. Hu shall attend working of the
streets under direction of the street
committee, and to notify all parties
subject to street duty of the time aud
place of working, and the tools to be
used, and furnish the Clerk with a list
of all defaulters, who shall be dealt
with by the Mayor according to the
town ordinances.
The salary of the Marshal shall be
$25 per month, and 50 cents as cost for
the arrest of any party in the daytime
and $1 in the night, followed by con¬
viction, to be paid by the defendant.
He shall further be required to per¬
form all the duties in the ordinances
recited, and shall not leave the town
without the consent of a majority of
the council; nor shall he delegate to
any other his authority without con¬
sent ot a majority of the town council.
And it shall further be the duty of said
Marshal to meet the day passenger
traius running through said town.
BONDS OF CLERK AND TREASURER AND
MARSHAL.
13th. Immediately upon their elec¬
tion, the Clerk and Treasurer, and city
Marshall shall execute to the Mayor
and Aldermen and their successors in
office a bond—the Clerk and Treasurer
in the sum of $20 and the Marshal
tiro sum of $200, to l>e approved by
the Mayor, conditioned by the faithful
discharge of their duties; and for a
violation of their duties shall be sub
j'cet to a fine of not less than $2.50 nor
more than $25 for each offense, by the
Mayor, and also may be, by I lie coun
oil, dismissed from office, and shall be
subject to a suit upon said bond,
14th. Upon a failure of the Mayor
to attend the council, unless sufficient
eqcuso be rendered, lie shall be fined
by the Akiernien in a sum of not less
than $2.50, nor more than $10.
15th. Any two or more Aldermen,
upon the information on oath of any
tax payer, for the breach or neglect of
i duty on the part of the Clerk and
j Treasurer said breach or Marshal, neglect shall of investi- duty,

after giving said Clerk and Treasurer
or Marshal five days notice of said in
vestigation ; subpoenas for witnesses
shall be issued upon application of
either party, and the party convicted
sluill be liable to such tines and costs
as the court may impose. ^
REPORT OF OFFICERS.
16th. It shall be the duty of the
Mayor, Clerk and Treasurer and Mar¬
shal to make a written quarterly re¬
port to the council of all their official
acts.
SALARIES OF OFFICERS.
17th. The Mayor shall have for his
services $75; Aldermen shall be ex¬
empt from street duty; the Marshal
receives $25 per month; the Clerk and
Treasurer receives $25 per annum and
2l£ per cent on all money received,and
2}.< per cent on all money paid out.
SPECIAL TAXES.
Each dealer in domestic wines, cider,
lemonade or soda water, $75 per an¬
num.
Each place of business not doing di¬
rect special tax herein specified, $6 per
annum.
Each dealer in commercial fertilizers,
$5 per annum.
Each grist mill and cotton gin $5 per
annum.
Each turpentine still. $5 per annum.
Each steam saw mill, $10 per annum.
General livery busiuess, $25 per an¬
num.
Each boardinghouse or hotel enter¬
taining transient customers, $10 per
annum.
Each person other than restaurants
selling meals orlunehes, $5 per annum.
Each restaurant, $5 per annum.
Each wheelwright or carpenter shop,
$5 per annum.
Each shoe or harness shop, $5 per
annum.
Each blacksmith or repair shop, $5
per annum.
Each barber shop, $5 per annum.
Each candy or fruit stand on the
streets, $5 per annum.
Each jeweler or repairer of clock or
watches, $5 per annum.
Each artist or photographer, $5 per
annuls
Each peddler, $5 pel* annum.
Each wheel of fortune, $10 per day.
Each shooting gallery, $10 per an¬
num.
Each pool or billiard table charging
for playing, $5 per annum.
Each ton pen alley, $5 per annum.
Each and every circus company, $25
per day.
Each corn doctor and others of like
character, and other performances than
above described and specified, at the
discretion of the Mayor.
DUTY OF THE TAX PAYER.
18th. It shall be the duty of all per¬
sons owning property subject to taxa¬
tion to make a return thereof in per¬
son, or by agent, under oath to the
Clerk of all such real or personal prop¬
erty at Its true market value, by the
first day of July, owned on the first
day of June, and to pay the tax thereon
by the first day of October thereafter.
19th. All parties who fail, or refuse
to make returns by the specified time
shall be doubly taxed, and executions
issued therefor by the clerk.
GENERAL PROVISIONS.
20th. It shall be unlawful for any
person, without good and sufficient
reasons, or permission first obtained
from the marshal, t© make, build or
have any fire in the streets, alleys or
enclosures, cither in day or night time.
For every violation of this ordinance
the party or parties so offending, on
conviction shall be fined in a sum not
to exceed $20, or imprisonment not to
exceed ten days—or both, at the dis¬
cretion of the court.
21st. Any person who after being
notified by the owner or occupant, to
quit or leave the inclosed premises of
another not to visit said inclosed
premises, and shall disregard such
notificaton, the same shall be held
and deemed an intruder and on con¬
viction thereof be punished by a fine
or imprisonment of not more than 20
days—or both at the discretion of the
mayor.
22d. The following offences are
prohibited within the corporate limits,
except in such cases of justification or
under circumstances of emergency as
may be shown by proof:
1st. Fighting.
2<l. Loud quarreliug aud
ling
3d. Riots.
4th. Indecent language or beha¬
vior,
5th. Loud and profane swearing.
6th. Insolence to ladies.
7th. Resisting lawful arrest.
8th. Obstructing 6trtet and side¬
walk.
9th. Hitching animals to shade
trees.
10th. Riding or driving on side¬
walk.
lith. Hitching animals (o private
houses or fence without consent of
owners.
12th. Causing or permitting nui¬
sances to remain about one’s premia*
es.
13th. Shooting firearms or fireworks
of any description except by permis¬
sion of the Mayor.
14th Using fire or combustibles
without due caution.
15th. Disorderly assemblages.
16th. Injuring shades on public or
private property.
17th. Trading on Sunday.
18th. Loiteringaboul town without
employment or means of support.
19th. Keeping disorderly houses.
20th. Drunkenness to the annoy¬
ance of the public.
2lst. Lurking about the streets at
unusual hours.
223. Riding or driving on the
streets at an unusual gait.
PUNISHMENT.
23d. Where punishments are not
fixed or limited by the code they shall

24th. All able-bodied males between

corporate limits shall be subject to
street tax and shall be required to
work the streets not exceeding fifteen
days per annum or otherwise pay a
commutation tax of 75cents per day
for every day the streets arc worked.
25th. Re it ordained that before
any ordinance or resolution shall be
passed, it shall be read at least once
in open council, and receive a majori¬
ty votcot all the members of the coun¬
cil ; and all* ordinances to bccomo of
force, shall he entered upon the min¬
utes and be published in such man¬
ner as the council may prescribe.
26th. Be it ordained that no person
shall engage in any business for
which license or special tax is re¬
quired without first obtaining such
license or paying the special tax, and
any person violating this ordinance
shall be punished on conviction, by a
fine not to exceed $50 dollars, or im¬
prisonment not to exceed ninety days
for each offense.
27th. l)e it ordained, that any fine
imposed for tho violation of any ordi¬
nance of the town, may be enforced,
if the council so directs, by an execu¬
tion against the violator, to be cn
i forced and collected by levy and sale
of the property of defendant in fi. fa.,
to be found in the town, as other exe¬
cutions are enforced and collected.
All executions shall be signed by the
clerk of the council, and bear test in
the name of the Mayor, and shall be
directed to the Marshal by whom, or
his deputy, they shall be levied and
enforced.
