' CITY OF HARTWELL, GEORGIA, FOR YEAR ENDING MAY 1, 1926

SECTION 1. Be it ordained and
enacted by Board of Aldermen of the
City of Hartwell, Georgia, and it is
hereby ordained by authority of the
same, that from and after the pas
sage of this ordinance each individual,
♦ firm or corporation engaged in the
business, profession, or occupation
hereinafter set forth shall pay the
amount of license or specific tax set
forth for the privilege of conducting
said business, trade, profession or oc
cupation in the City of Hartwell,
from the first day of May, 1925, to
the first day of May, 1926. The busi
ness, trade, profession or occupation

and taking license for the same as
prescribed in this ordinance shall
be subject to visitation and inspec
tion from the Police Force of this 1
city, and on refusal of such per
son to submit to such visitation
and inspection, such houses, shall
be closed immediately and license
revoked. If any articles of value
are found therein and the keeper
or owner of such junk shop cannot
explain its presence therein, the
keeper or owner thereof shall be
subject to fine upon conviction in
the Mayor’s Court as herein pro
vided. All licenses are granted
subject to this provision.

WOODYARD, or dealer in wood
All dealers or merchants of what
ever kind or character not herein
provided for in thia ordinance,
shall be classed as general mer
chants or shop keepers and be tax
ed accordingly.
Any non-resident person, firm or
corporation engaged in soliciting and
selling in the City of Hartwell, any
goods, wares, . merchandise or com
modities and delivering same at time
of sale or afterwards, by wagon,
truck, or other vehicle or manner,
other than by a public carrier in the
usual course, shall be subject to the
same license tax as prescribed and
fixed in these ordinances for resi
dents doing a like business in said
city, and subject to the same regula
tions and penalties as resident deal
ers.
SECTION 2. Be it further or
dained, that any person, firm or cor
poration, who shall attempt to do
any of the foregoing businesses,
trades, professions or occupations
above described without first obtain
ing a license therefor and paying the
fees, shall be punished as prescribed
in section 7 of this ordinance.
SECTION 3. Be it further or
dained by the authority aforesaid
that all licenses issued under this or
dinance for specific or special license
tax shall be posted conspicuously in
the place of business of the person,
firm or corporation, to whom the li
censes are issued, and upon their
failure to do so, the license in the
discretion of the Mayor, shall be re
voked and they shall be punished as
prescribed in Section 7 of thia or
dinance.
SECTION 4. Be it further or
dained by the authority aforesaid
that the Mayor of the City of Hart
well shall have the right to revoke
any license issued under this ordi
nance whenever a person doing busi
ness under such license shall violate
any law or ordinance of the United
States, or of the State of Georgia,
or of the CHy of Hartwell, in pur
suance of such business conducted
under such license or when it shall
be proven before the Mayor that the
health, morals, interest and conveni
ence of the public demand the revo
cation of such license, or the per
son, firm, or corporation holding
such license fail to comply with the
spirit and intention for which the
said license was issued, and said
Mayor shall report revocation of
such license to the next regular meet
ing of the Board of Aidermen for
their ratification or rejection and
should the action of the Mayor be
sustained by the Board of Aldermen
thence the said license shall be per
manently revoked, otherwise it shall
be restored and remain in full force.
SECTION 5. Be it further or
dained by the authority aforesaid
that none of the licenses issued un
der this ordinance shall be transfer
able or used by other than the party
to whom issued, unless by the con
sent of Board of Aidermen.
SECTION 6. Be it further or
dained by the authority aforesaid,
that all money collected from the li
cense or specific taxes provided for
in this ordinance shall be placed to
the credit of the general expense ac
count of City Government.
SECTION 7. Be it further or
dained by the authority aforesaid,
that the license and specific taxes
herein specified, shall be issued by
the Secretary and Treasurer of the
Board of Aidermen, and if any per
son, firm or corporation, or agent of
any corporation whose duty it is to
register and take out license, shall
transact or offer to transact in the
City of Hartwell, either of the kinds
of businesses, trades, professions, or
occupations in this ordinance speci
fied without having first obtained li
cense, he, she, or they, or such
agent, shall upon conviction before
the Mayor acting or by one or more
of the Board of Aidermen, holding
court, as the case may be, shall im
pose a fine upon all offending this
ordinance of the City of Hartwell,
not exceeding ONE HUNDRED DOL
LARS, imprisonment in the city
f calaboose (or in the county jail of
I Hart county by permission of the
county authorities) not exceeding
90 days; work in the city chaingang
not exceeding 90 days; any one or
more of these in the discretion of the
trial court.
SECTION 8. Be it ordained by
the authority aforesaid, that upon
failure of any individual, firm or
corporation to register as aforesaid
the Secretary and Treasurer of the
Board of Aidermen shall from the
best information in his reach regis
ter the same and the police shall re
i port all omissions known to them.
On failure of any individual, firm, or
corporation to comply with the pro
visions of this ordinance the Secre
tary of the Board of Aidermen shall
issue a fi fa and place the same in
the hands of the policeman or other
officer for collection, the same to be
collected as any other executions
are collected. All persons, firms,
or corporations, before doing busi
ness in the City of Hartwell and not
herein classified and who are not
exempt by State law, shall pay a
special tax, the amount to be fixed
and agreed upon by a majority of
the Board of Aidermen, before said
business is commenced. A failure
to comply by any person, firm or cor
poration, when business is not spe
cified in this ordinance will be sub
ject to same penalty as other viola
tors.
SECTION 9. Be it further or
dained by the authority aforesaid,
that all ordinances and parts of or
dinances conflicting with this ordi
nance shall be, and the same are
hereby repealed.
