Be it enacted by the Senate ad House of Representatives of the slate of Geor gia in General Assembly met, and it is hereby enacted by die same, That so soon after the passage of ibis act, as circum stance* may require, it shall be the duty of his Excellency the Governor to appoint two tit and proper persons to superin tend the improvement ofthe public roads and the rivers of this State, who shall be < einnvahle from office at the pleasure of the Governor, who in case of such rentov d,m-y appoint others in their stead. Sec 2. And be it enacted by the an thority aforesaid, That the sum of fifty! thousand dollars, including the twenty thousand dollars, heretofore appropriated for the improvement of Savannah ri-, ver above Augusta, be and the same is hereby appropriated, out of any funds in j the Treasury not otherwise pledged, to I and for the purchase of such a number j of able badic rl negroes, within the State of Georgia, and who have been in Geor- a twelve months, as will,in addition to t?ie number now owned by the State, amount to the number of one hundred tmd nine ty. Sec 3. And bo it enacted by the au | thority aforesaid. That as soon as the two said sir erintendami9 shall be appoint ed, they shall be respectively assigned by .Ins Excellenty the Governor to take I charge of the public hands, as follows—, that is to say, one to take charge of the public bands to he placed at Augusta, Savannah and MiSledgeville; and one to take charge of the public hands to be pla ced at Macon am! Columbus, and on the waters of Flint river as hereinaftei pro vided; and *uch superintendents shall place the public hands so placed under their charge respectively, on such public road* and r ive's. us hereinafter provided for and designated. \nd the saiid super intendents are hen by authorized and dt* reeled to take charge of the said public hands *o committed to thorn and place the same to wo*k accordingly within their •respective di-trict Sec 4 And be it further enacted by the authority aforesaid, That as soon as the said superintendents are appointed that his Excellency the Governos be, and he is hereby authorized to place the put) lie hands now woikmg on the river Chat tahoochee, or which are in that neighbor hood at Columbus; provided the number so placed there does not exceed twenty five; anti to place the public hands now. or lately working on the Ocmulgee, at Macon, provided the number so placed there does not exceed twenty-five inclu ding those lately working on the Ocmul gee and now hired out, and to place the hands now working on the Oconee, at Milledgeville, provided the number so placed there does not exceed fifteen, and the residue of such public hands, includ ing those not working on the Altamaha river or its branches, below or near Da rien, at Augusta, provided the same does not exceed seventy-five, and that the re mainder, if any together with others to be purchased under and by vutue of this act, to make up the number of twenty five, be placed at Savannah, and twenty five on j the Flint river.*and after the said twenty five be so placid at havarmah that the hands remaining to be purchased in pur suance of this act, shall as soon after the purchase as practicable, be placed at Augusta, Milledgeville, Macon, flint Ri ver, and Columbus, as may be most con vement, until the whole number placed at Augusta shall amount to seventy five; the whole number placed at Milletlg- ville to fifteen—-the whole number placed at Ma con to twenty five—-the whole number placed at Columbus tu twenty five an the whole number placed at Flint River, twenty-five. Sec. 5. And be it further enacted by the authority aforesaid, That the public hands lately working on th. Ocmulgee, and now hired out, sha'l immediatefy af ter the expiration of the term lor which they are now hired out, be placed at Ma* con, in addition to the public hands pre vioudv placed there by virtyeot this act, provided the do not exceed twenty five in number, in which case only that number shall be placed there. r r .^ ec * And be it further enacted, 1 aat *f Rer the purchase of the negroe provided for by thi* act, and balance of the money hereby appropriated, shall re main unexpended, that then the same shall be invested in the purchase of ne groes to be added to those herein before directed to be placed at Milledgeville. Keaton of Lee, j fsac Welch of Baker, Bennet Crawford jof Decatur, Richard Mitchell of Thomas, Matthew A-brifton of Lowndes, a majori ty o! whom may act, be, and they are j hereby appointed a Board of Cominis sioners to superintend the improvement |of f lint River, and Roads in that portion :of this State, through which said Rivers flow, south of the Federal road leading srom Vlaeon to Columbus, who shall be vested wuh the siime, and equal powers granted to the anil city councils by this act of the incorporated towns of this state, having th supervisor ship of the bands appropriated for the im provemtmt of the rivers and roads of this state. Sec. 4. And be it further enacted by the authority aforesaid, That there shall be seven overseers appointed in manner following, that is to say, two by the city council of Augusta; one by the city coun cii of Savannah, and by the commissioners of each of the towns of Milledgeville,’ Macon and Columbus, and by the com missioners ol Flint river respectively And the said city councils and board* of Commissioners respectively, are hereby authorised to mike such appointment*, and with the concurrence of the superm tendant of the division to remove them from office and appoint others in their stead. Sec. 9. And be it further enacted by the authority aforesaid, That it shall be the duty of the said superintend ents re spectively. to superintend and control the public hands placed under th**u’ charge respectively ? as aforesaid, to provide for their clothing, maintenance and support, and purchase such implements, and tools, horses, carts., canto equipage and other necessaries for their use, as they may ieed, in addition to such as the state now owns. Sec. 10. .4 nd be it further enacted by the authority aforesaid That it shad be the duty of *aid superintendents respectively, to place the hands assigned to their charge a* aforesaid, at each city or town as afoi e said, under the direction of rhp overseers respectively appointed by the authentic* as afursaid, and to proceed with all possi ble dispatch to work o* arid improve -uch roads and rivers as may be designated t them, in the manner and by the authority hereinafter provided Sec. 11 And be if further enacted bv the authority aforesaid, That the said su perintendants shall each receive the sum of eight hundred dollars per annum for his services per year to be paid quarterly, provided that said-salaries shall not be deemed to commence until they shall have respectively actually commenced to discharge their respective duties —and that in addition to the salaries so allowed, the said overseers shall be fuimsned with provisions, by the supenntendants, at the public expense. Sec. 12. And be it further enacted by the authority aforesaid, That the city councils of Augusta and Savannah res pectively, and the commissioners of the towns ol Milledgeville, Macon, and Co lumbus, and the commissioners of Flint river resppctivply, shall be and they are hereby authorized to select, designate and direct from time to time as occasion may equire, the road or roads, river or rivers r parts of rivers on which the public hands placed at their respective cities or towns or place as aforesaid shall work; provided that nothing herein shall be so (instructed as to authorize them at any ime to employ the said negroes to work vithia the,corporation limits/or to author- lie the said city councils or .onm *. . 8 or any of them or the said superm en l ints to direct or require the said negro- * to work on the rivers more than once a vear, nor for a longer period than four months m any one year at the discretion of -aid authorities: and it shall be the duty ofthe said superintendents respectively, at all times, to employ the said bauds respect ively on such road*, rivers or parts of riv ers as may be so selected and designated by the said authorities respectively, c >n formably the true intent and meaning of this act. hec. 13. And be it further ernrted by the authority aforesaid, That the said superintendants in the respective and v.** ions assigned to them, shall have power to alter and amend the direction of said roads which may be designated to them, not materially effecting the rout of said road*, if in opinion of sue superintend aot, such alteration would conduce to he improvement or shortening of the same; ptovided that if any pers-m or persons through whose enclosed premises e ich alteration of said road map r...., .Koil Winn themselves or him or herself ig grieved or injured thereby, h<*, she nr they shall be entitled to the same remedy as is pointed out bv the road laws of this state now in force. Sec. 14. And be it further enacted by the authority aforesaid, That if any person or person* whatever shall wilfully md intentionally imped-* or attempt t * irn >ede the said superintendants or either of them or the said overseers or either of th in, or the said public hands, in working on the road or roads which may be selected and designated for them to w--rlc upon a* a foresaid, he she or they, so >ftending shall be liable to indictment befote the superior court held in the county where the of. fence wa* committed, and shall on ron. viction thereof, he fined in a *uin not ex ceeding giso; arid further, if any person or persons shall knowingly intentions lly and wi'fully stop ui, obstruct, or turn or change any put*ic road, or the direction thereof which shall hav been laid out. or made, or worked up ili or improved under and by virtue of this act, *uch per. son nr persons so off ndiug shad be liable to indictment in the Supe-ior court held in *uch county, and on conviction thereof, shall be fined in a sum riot exceeding 200 dollars. Sec. 15.
