patcel of land, lying and being in the
City of Commerce, Jackson County,
Georgia: being a house and lot locat
ed, on South Elm street, and front
ing on South Elm street 134 feet and
2 inches, beginning at the corner of
lot of Mrs. D. Stark, and running
along South Elm street to the corner
of Miss Ida Bohannon, thence along
the line of Miss Ida Bohannon 212
feet to a point on College avenue,
thence along a line of a vacant lot
142 feet to a corner on Mrs. C. D.
Stark line, thence along the line of

228 feet to College avenue, thence
along College avenue 65 feet and 6
inches to the beginning corner. On
this lot is erected a one story frame
dwelling.
All of the above property will be
sold as the property of Mrs. B. H.
Cooper, deceased, for the purpose of
paying debts of said estate and dis
tribution among the heirs at law of
the said Mrs. B. H. Cooper, deceased.
There is outstanding a security
deed against Tract No. 1 of the prop
erty above described, but the holder
of said deed and debt against said
estate agrees to let his lien attach
to the fund derived from the sale of
said property, in order that the ad
ministrator may execute and deliver
title and possession to the purchasers
of suiid property, and so much of the
funds as may be necessary that is
derived from the sale of said proper
ty be paid by the administrator to
the holder of the debt and security
deed, in order that same may be re
leased; and in case the above describ
ed property fails to bring a sufficient
sum to pay said debt of said lien
holder, then the lien holder agrees
to release his lien and look to the
other assets of said estate for the
balance of his debt. This Bth day of

of default in the payment of a loan
secured by a deed to secure debt ex
ecuted by E. B. Anderson and Mary
L. Anderson to the undersigned, dat
ed the 19th day of December, 1925,
and recorded in the office of the
Clerk of the Superior Court of Jack

clared the full amount of the loan,
with interest, and advances made by
the undersigned, due and payable,

ber, 1933, acting under the power of
sale contained in said deed, during
the legal hours of sale, at the court
house in said county, sell at auction
to the highest bidder for cash the
lands described in said deed, to-wit:

died since the execution thereof, the

this land from land of Dadisman
estate and Pinson land),,ofi the east 1
by land of Claud Hancock, on the
south by land of Duke, and on the
west by Niblaek land.
Said land will be sold as the prop
erty of Sam Kelly and J. P. Kelly,
having been levied on under an exe
cution issued from the City Court of
Jefferson, in favor of E. D. Wier and
E. L. Wier, as executors of the will
of Mrs. Annie L. Wier, deceased,
plaintiffs in fi fa, against said Sam
Kelly and J. P. Kelly, defendants in
fi fa; said execution being issued on
a judgment rendered February 27,
1933, in the City Court of Jefferson,
for the principal sum of $3,000.00,
besides interest, attorneys’ fees and
costs as stated in said judgment.

Said land, at the time of levy, was

thereof. A quit claim deed has been
executed by the plaintiff to defend
