By *n Act of the General Assembly of th« State of
Georgia, approved October 34, 1870, authority is given
to the Govenor to Ires* th. Western wd Atlantic Bail
road, the property of tb. Btate, together with all of its
houses, workshops, depots, rolling stock and appur.
tenaneea of every character, for the term of twenty
year*, upon certain terms, and. subject to certain re
striction* therein named, to-wit:
The monthly rental shall not be leas than twenty,
five thousand dcdlan (3S.TWO) payable monthly. Tho"
lereeM shall gllve bond for the sum of eight millions
of dollars (8,000,000) to securing the prompt payment
of the amount of rental agreed upon, aud for the re
turn of th* road and ita appurtenanore at tho expira
tion of the lease, or on the termination or forfeiture
thereof, In as good condition seat the time of leasing
five million. (5,000,000) of which securities shall be
within the State and the Bsllance. if out of the State,
shall bain real estate or railroad property. Theles

The Legislature reserves to it-elf the right, from
time to time, to examine into affairs of the lessees, sod
to require that the amount of security above recited
shall be maintained unimpaired.
The lessees shall not b* less than seven in number, a
majority of whom shall have been for five years bona
fide residents of this State, and shall represent a ma
jority of the whole interest in the Isaac. No railroad
or express company' or any combination ofthem, shall.
In any event, become the lessees, but they may become
snreitos on tho bonds of the lessees. The leasees
.hall not charge a higher rats for local freights over
aaid road than the avenge rate cha.ged by the Geor
gia Railroad and Banking Company, the Central Rail
road and Banking Company, aud the Macon and Wes
tern Railroad Company, for like local freights over said
roads, aud tho said lessees shall have the same rights,
exemptions, privileges, immunities and guarantees, ex
cept the establishment of banks, and shall be subject
to the same liabilities, disabilities, and public burdens
of said railroad companies last mentioned. The faith
of the State is pledged to redeem all mortgago bonds
and coupons now resting on tho State Road aa they
foil due, and to save thp lessees harmless against all
such bonds and coupons.
Tho lessoosaro by this act constituted a body corpo
rate and politic for tho term of twenty years, under
the name aud etyle of the Wester and Atlantic Railroad
Company, having such powers, liabilities and immu
nities, as are usual with railroad companies, and not
in conflict with the Constitution and If wrof the Uni
ted States, and of tho State of Georgia; but they will
not be allowed to make or permit any discrimination
in favor of or against any other road or persons hav
ing business connections with the said Western and
Atlantic Railroad.
For tho purpose or carrying out this act, proposals
will bo received until and including the 25th day of
December next, and mu«t be addressed “to tho Dover -
nor of tho State of Georgia, at Atlanta,” aud marked
on the wrapper, “Proposals for tho lease of ths Wes
tern and Atlantic Railroad, in accordance with an Act
approved October 24, 1870.” The proposals must
state tn full the names residence of the parties uniting
to make proposition, the amount that each of the par
ities therein named are worth over and above their
debts and liabilities, together with a full description
of the charter of tho security which will bo offered to
complete the bond.
Tho property to be leased is a singlo track railroad
one hundred and thirty-eight miles iu longth, with
fell and complete equipment of shops, depots, turn -
outs, Biddings, engines, ears, ect., etc., now in suo
cessful operation between the Cities of Atlanta, in Geor
gia, and Chattanooga, ia Tenuossoe. At Chattanooga
the lino is in diroct communication with tho Memphis
and Charleston, NashvUle and Chattanooga, Chatta
nooga and New Orleans, East Tennessee and Georgia,
and the Chattanooga and Cincinnati, (now in progress
of construction,) railroads, and at Atlanta with the At
lanta and Montgomery, AtiantaandChsrleston, Atlanta
and Savannah, and tho Atlanta aud Gulflines of road,
being the only railroad connection between the system
of railways oentoring at Chattanooga and at Atlanta.

mentioned," approved October 24th, 1870, can be had
