Another important ease has l>een j

the rights of loan companies, doing
business and charging agent’s lees,
in this State, above the permitted
rates of interest.
The case was brought by the New
England Mortgage Security company
against Jacob McGay, and the decis-
ion of Judge Speer was in accord
with one previously made by him in
| n similar case.
This company, through the Corbin
Ranking company and agents U1

the circuit court of the United States,
and once before the supreme court of
Georgia. In tho latter court, the
lender won, while both cases in the
former were gained by the borrower
The difference in the decisions, how
ever, may be accounted for by a dif¬
ference in the proof, the only ques
tion being, whether intermediaries
were audits *f the mortgagor or
mortgagee.
