Schaefer A Co., a firm Barker, composed of A. C. Schaefer and Geo. Y. made uml delivered to said Wal ter T. Miller a certain mortgage in whioh the sum of Six Thousand Dollar* was ao knov.'ledged to be uue the said plaintiff, a hicb said mortgage deed hears dale April 1st, 1872, to secure the payment of said amount du , whereby they conveyed to said •'alter 1. Miller the fo lowing described property.to-wit: That tractor parcel of land lying Monroe, or being in the 3d District of originally then Pike, now Spalding County, and known and distinguished in the plan of said district as No*. Forty.»cven (47), Seven ty n (51), ne (70), each Seventy-eight (78), and Fifty- one containing Two Hundred and Two anil One-half (202X) acres; also, Seven, live No. (75) Seventy-seven acres in the northwest comar of tot io southeast (77); of also, Fifty (50) acres part iot No. Forty eight (48), all in same district, containing in the aggregate Nine Hundred and Thirty-five (035) acres, more or less, in the entire tract, bounded north by land then known as Jno. G. Lindsay’s land and others, east by land then known as lund of Dr. Pritchard and others, of south by Buck Creek, and west by land Squire Masse(t and others, being premises conveyed by Philip E. McDaniel to said defendants r ebruary 4lb, 1868. as deserib ed in foregoing petition; conditioned that If said firm of A. C. Schaefer Ac Co. (of which A. C. Schaefer is now survlng partntr) should pay off and discharge said debt of Six Thtusand Dollars accotding to its tenor should and effect, be that then said Deed of Mortgage void. And it further appearing that said debt re mains unpaid ; it is therefore Ordered, that said atoresnid, A. G. Schaefer, into this surviving partner as pay Court by the first (lay of the next term thereof, th<- principal, intcrett and cost due on said Mortgage, or show cause to the contrary, if there be any; and that on failure of said A. C. Schaefer, sm viving partner as aforesaid, so to do, the equity of redemption in and to said mort giigi il premises be forever thereafter barred and foreclosed. Aud it is further Ordered, That this Rule he published in the Griffin Nxws once a month for four months, or a copy there of served on the said A. C.
