City and the Company.

the city and the Griffin Water and
Light Company:
State of Georgia, Spalding Coun¬
ty.— -This indenture made and enter¬
ed into this 25th day of June, 1890,
between the Mayor and Council of
the city of Griffin, party of the first
part, and Messrs. W, A. Robinson, J.
F. Robinson and W. A. Bedell, of
said State, and their associates, con¬
stituting the Griffin Water and Light
Company, of the second part, wit-
nesseth:
That for and in consideration of a
rental in lawful money of the United
States, to be paid as hereinafter get
forth, by tbe party of the first part
to the party of the second part, tbe
said party of the second part agrees
to do and perform tbe following
covenants stipulated as follows:
To erect waterworks, with a reser¬
voir capable of holding 30,000 gal¬
lons, or more, of water, and sufficient-
ly high to give a pressure on the
mains so that from a hydrant locat¬
ed at the intersection of Hill and
Solomon streets, and through one
hundred feet of fire hose, and a one-
inch nozzle, to project a stream of
water vertically a distance of irZ fifty
purposes and the necessary demands
of the fire department in its practic¬
ing and parades, forty (40) hydrants
of the usual pattern, with nozzles to
fit the department’s hose, and to be
placed on the main pipes of not less
than four inches in diameter. The
hydrantsts be located on the princi¬
pal streets under tbe supervision of
the Street Committee, and not furth¬
er apart than an average of three
hundred feet. Also to supply with
water the City Hall. Guard House
and Engine Houses, and two drink¬
ing fountains to be erected and pipe
connections to be made thereto by
the City at such places as they may
designate on the lines of the mains.
All other fountains the City may de¬
sire to erect to be paid for at the rate
of not exceeding twenty-five- (25)
cents per thousand ( 1 , 000 ) gallons
used; these fountains to be for the
use of the public and for domestic
purposes only, and hot for manufac¬
ture or Sales.
The following to be the maximum
rates for water, per annum:

No continued flow of water through
any opening allowed, and letting it
run to prevent freezing is strictly
prohibited.
Paynltent of water rents must be
paid monthly, and bills remaining
over due fifteen days will render the
consumer liable to have the water
cut off, and in such cases fifty (50)
cents will be charged for the work of
turning it on again.
Bills by meter must be paid month¬
ly-
C o nsume r s a re not allowed to sup¬
ply any premises but their own with
water under penalty of the Company
refusing to Bell to them.
Tbe city to pass such ordinance
as shall protect the party of tbe
second part and its property,
and enforce Buc-h penalties
and fines upon any one injuring said
property as shall be within the limits
of its charter.
In consideration whereof and for
the work to be done and service to
lie rendered, the party of tbe first part
hereby agrees to pay to the party of
the second part, the sum ot fifty
(150.00) dollars per hydrant per
annum, in equalquarterlypayments,
on the first days of January, April,
Ju'y and October of each year, or
monthly as desired. If Baid party of
the first part has not funds sufficient,
or, for any cause does not pay said
money at the times fixed aforesaid,
then and in that case, vouchers shall
be issued to the party of the second
part for said sums, which vouchers
shall draw interest at the rate of
seven (7) per cent. Der annum, until
paid.
And further, the party of the first
part gives to the party of the second
part the exclusive privilege of streeig, laying
.water and gas pipes in the
lanes and public highways of the
city for the convenience of water and
gas privileges, provided always, that
the public domainshall not be unnec-
cessarily obstructed, and tbe road¬
ways left in as good condition as be¬
fore the.laying of said pipes. And it is
further agreed that the company

parts of this contract hereby agree
that this contract shall continue in
force for a term of twenty years
from the time tbe said waterworks
are completed and ready for duty,

tion of the first five (5) years per-
forrcance of this contract, then, one-
fourth (X) of the stock of this water
company shall revert to the city of
Griffin, Ga., as its property, in com¬
mon with all other stockholders of
the said water company, and at the
end of this contract the city shall
have the right to purchase tbe re¬
maining common stock of said water
company at a price to be agreed on
by arbitration, or the terms to be
satisfactory to both parties, by giv¬
ing tbe party of the second part
notice six months in advance of its
intention to do Should the city
not wish to purchase then, this con¬
tract to be renewed for not less than
five years.
And it is further agreed that the
party of the first part reserves the
contract forfeited and at an end, in
case the said party of the second part
does not begin the eonstruetion of
the works by or before the 25th day
of August 1890 and complete February the
same by the 25th day of
1891.
It is further agreed that as the other city
grows, and for such, or any
reason, that the more party hydrants of the secorn be md required, part
shall erect them and the city shall
pay for them in addition to the rent¬
als already stated, tbe sum of fifty
($50.00) dollars each per year, for
each additional hydrant, shall provided
the party of the first part not
require any hydrant on a street
where the mains of the company have
not been laid, and that they shall
not be further apart than heretofore
stated, provided that not less than

water compay, by which water
is obtained at a less rgte than the
rate submitted by this company,
this company agrees to meet such
rate.

Tbe Georgia Midland Accident. 'A
The wreck on tbe G. M. A G. RR.
on Wednesday was occasioned by
one freight train running into the
rear end of anotherat Warm Springs.
The cause in the long delay of clear¬
ing the track was on account of a
number of large, heavily built vats,
to be used by the Chattahoochee
Brewing Co., which were loaded on
fiat cars, getting jammed togetherin
tbe cut and much time was taken in
getting them out without cutting
them up. No one was hurt by the
accident, and the damage done was
small, being the wrecking only of
two or three cars. The delayed
trains reached here about 3 o’clock
