stock contracted with the transport
ing railroad that it was not to be
responsible for attention, feeding
or watering of the stock, but that
it should nllord the shipper reason
able facilities for those purposes,
yet if the railroad carried the stock
beyond the destination fixed by
the hill of landing, and there de
tain them fur several days before
their return it would not be reliev
ed from liability tor failure to cure
for thu stock after passing the
proper destination.
3. When the Central railroad re
ceived live stock at Atlanta to lie
transported to Amcricus over its
road aud that of tho Southwestern
railroad, ami by a mistake outlie
part *f the first road, they wore
consigned to, a point bepond Amer
icas, nnd were so received and car
ried by the connecting road, such
facts would not relieve thu latter
from damages occurring by rea
son of inattention to thu stock nt
tho place to which they wore actu
ally carried.
4. Though under the contract of
shipment a railroad may have beon
liable only for damages arising from
gross ucgligcnce in not attending
to live stock, yet where it carried
the stock beyond tho agreed des
tination und there kept them for u
time, its liability as to such time
was not limited to thu . results of
gross negligence.

ance on account of the absence of
a witness. These are matters rest
ing in the discretion of tho court.
2. The grant or refusal of alimo

is a matter of discretion for the
presiding judge, and his decision
will not lie controlled unless that
discretion has been abused.

little twelve year old girl and is

signing reporter, who utilizes her
for*the purpose of securing a sen
sation, sho being always conve
niently stopped before site, goes
anywhere.
Columbus Times: Yesterday
two car loads of piping arrived for
the water works. It consisted of
twenty-four and twclvo inch mains.
This will bo followed soon by oth
er and lnrgcr shipments. Thus it
will be seen that the work has be
gun in earnest, and will be pushed
during tho spring and summer to
an early completion. It will fur
nish work for a large number ot
hands, five hundred or more, and
will greatly aid to bridge over the
dull months.
