A ease was decided yesterday by Judge Pllabury, in the eodnty court, which has given rise to considerable discussion of the law on the subject In rendering bis decision, the Judge took'occasion to. remark'that, In his opinion, the law needed revision, as it was manifeetly too - sweeping, in Insist ing on something that bordered, in many cases, on the impossible. The facts areas follows: Mr. J. U. George and wife moved here from Seville six months ago. He secured em ployment and started in with his wife housekeeping in a small way. He at tended to his business regularly, spent his nights at home, and made few ac quaintances. In due time, his wife de cided to return to her father's home iu Seville, on account of an interesting event which is generally foreshadowed in ail well-regulated families. On his wife's departure, Mr. George rented bis house and went to boarding in an obscure street in the same vi cinity. Time rolled, and on Juno 8 last a tel egram was sent from Seville to “J. R. George, Americus.” The telegram read “Come home at once,” and was received in the regular course of business at the Western Union office here. As usual, this telegram was givon to a very small messenger boy to deliver. He startedjout at 0 o'clock In the evening, and after trying for over an boar to And Mr. George, he reported back to the office that he couldn’t And him. And the telegram was not delivered that night. No further effort was mado t j And Mr. George; but the telegraph oper ator here wired to the sending office in Seville for a mere definite address. Then came a second telegram for “J. R. George, care of Mr. Mitchell, Ameri cus." This second telegram reached Mr. George the nextday, June 0, and he also received the first telegram ac the Western Union office later on the same day, June 0. For failure, on the part of the messen ger of the Western Union Company, to find Mr. George on the night of June 8, the time of its receipt at the telegraph office, Mr. George sues the company for damages, claiming that the company did not make a reasonably diligent search to find the aforesaid Mr. George. Evidence was introduced to show that the above are the facts of the case. And on this evidence judgment was given for the plaintiff. And now the question comes up, Is that a good law? It it reasonable to suppose that a company or an individ ual should be able to locate every per son in a growing community of elght.or ten thousand people? And to locate them quickly, too. II to expect such a thing is unreason able in a city like Americus, with a pop ulation of a little less than ten thousand Inhabitants, what would it be in a city liko Atlanta? This is the conundrum which Is float ing around the court house at t])e pres enttlme. It is said the legislature will be asked to answer It. Mr. Fricker, of Flicker Bros., the large dealers in musical instruments and jewelry at Amerieus, was in Dawson last Friday for the purpose of Mooring a suitable house for that line of business in this city. Mr. Fricker was decidedly Impressed with the thrift and prosperity shown on every hand in growing Dawson, and the only thing that prevents Fricker Bros, from opening np a large stook of mosioal Instruments and Jewelry in Dawson at once,,1s their inability to secure a build ing, there not being a vacant storehouse in the city.' Mr. Fricker says bis bouse will cer tainly enter the field at Dawson, and he is now arranging with one of our citizens to build one of the handsomest store houses in this city for their occu pancy. Fricker Bros, will bo a decided acqui sition to the business interests of Daw son, and will be heartily welcomed.— Dawson Nows. A DANGEROUS POLICY. An Old Woman and Her Broken Down Son on the Bond. At the Central depot yesterday at noon might bare been seen two strange com' panione. One was an old, wrinkled, white woman, not far from the three score and ten mark. She was poorly dressed, bat not ragged nor dirty. Her hair was white, and she bore every evi dence of having had a hard straggle with the grim monster poverty. She was perfectly sober, and, with the ex ceptlon of having a hunted expression, she did not appear uneasy. Her companion was a man of possibly 40 years of age, with every evidence of viteness stamped on his bloated and bleared features. While not actually drunk, he gave one the impression that he had been a debauobee from his youth. His garments were shabby and soiled, but there was an apparent effort to make them look os presentable aa pos sible. While the queer couple lounged about the depot waiting for the train which was about due, a gentleman remarked that he had noticed them in a neighbor ing town only a few days ago; and that ho was informed they wore professional beggars. Tho old lady’s part was to do the so liciting, while the man acted os treas urer. os Another bystander remarked that he had heard they were mother and son, and that they had been traveling in this fashion for years. And further, that he understood tho mother at one time was in comfortable ciroumBtances, but that the son had gambled and dissipated the last dollar. When tho train arrived the old waman took the man’s arm, and led him away. Although on the brink of another world, she evidently was stilt the head of the firm.
