Was Groundless. It now develops that at tbe time i Montgomery* Eufaula road sued i an injunction against the Savannah, Americas * Montgomery road, to vent tbe latter from eroaing the track of the former road, tbe officers of both roads had come to an agreement whereby tbe S. A- * M. road began tbe construction of the trestlework between the M * E. tracks, near North Perry street, the agreement between the two roads had been entered Into. The M. E. was fearful lest tbe S. A * M. should ‘steal a march’,’ on It by crossing tbe tra;k at night. The evening the injunc tion was sued out, Mr. Campbell, Su perintendent of maintenance of roadway of the S. A * M., was ont of the' city, Agent Daniel Frazier of the M * E. this city received orders from Superin tendent Curran to telegraph to Mr. Campbell to find out if be intendeded to cross tbe Montgomery and Eu- faula tracks that night Mr. Campbell had left the city, as above stated and left word to Mr. Frazer that when the Savannah, AmeriCus *. Mont gomery crossed, due notice would be given to tbe Montgomery nnd Eu'auia. On that same evening Mr. Frazer tele graphed Mr. Campbell twice, but no ahswer came. Tbe telegrams were not delivered. . Tbe injunction then grew out of a fniluro to hear from those tele grams. It is now a fact that as soon as the Sa vannah, Americus * Montgomery com plies with the agreement as entered into with the Montgomery * ’Eufaula, by paying the stipulated consideration for crossing, the Montgomery * Eufaula will withdraw the injunction and then matters will be satisfactory.—Montgom ery Advertiser.
